S.I. No. 157/1953 - Córas Iompair Éireann (Birdhill-Killaloe Rail-Way Line) Exemption Order, 1953.


WHEREAS Coras Iompair Éireann applied on the 8th day of April, 1952, to the Transport Tribunal for an Exemption Order pursuant to Section 55 of the Transport Act, 1950 (No. 12 of 1950) in respect of the railway line between Birdhill and Killaloe and the service of trains thereon as specified in the Schedule hereto :

AND WHEREAS Notice of said application was duly published in the manner and at the times directed by the said Tribunal :

AND WHEREAS one objection by an interested party to the making of the Order applied for was received by the said Tribunal but said objection was subsequently withdrawn :

AND WHEREAS the said Tribunal held a Sitting for hearing the said objector and the Board on the 1st day of May, 1953, due notice whereof was given to the said parties :

AND WHEREAS at the said Sitting the said objector did not appear and after hearing the Board the said Tribunal decided to make the Order applied for without modifications and without any limitation as to the period of its operation :

NOW, WE, THE TRANSPORT TRIBUNAL, in exercise of the powers conferred on us by Section 55 of the Transport Act, 1950 (No. 12 of 1950) hereby order as follows :—

1. This Order may be cited as the Córas Iompair Éireann (Birdhill-Killaloe railway line) Exemption Order, 1953.

2. This Order shall come into operation on the 18th day of May, 1953.

3. Córas Iompair Éireann is hereby exempted from the obligation to restore the service of trains specified in the Schedule hereto which service was temporarily discontinued under the Emergency Powers (Córas Iompair Éireann) (Reduction of Railway Services) Order, 1944.

SCHEDULE.

The service of trains for merchandise on the railway line between Birdhill in the County of Tipperary and Killaloe in the County of Clare.
