EMPLOYMENT REGULATION ORDER (MESSENGERS (CORK CITY AREA) JOINT LABOUR COMMITTEE), 1953.

WHEREAS the Labour Court (hereinafter called " the Court ") pursuant to the provisions of Section 43 of the Industrial Relations Act, 1946 (hereinafter called " the Act "), made an Employment Regulation Order dated the 4th May, 1951 (hereinafter called " the said Order ") fixing the statutory minimum remuneration and regulating the conditions of employment of workers in relation to whom the Messengers (Cork City Area) Joint Labour Committee (hereinafter called " the Committee ") operates :

AND WHEREAS the Committee has submitted to the Court a proposal for revoking the said Order :

AND WHEREAS the Committee has also submitted to the Court the proposals set out in the Schedule hereto for fixing the minimum rates of remuneration and regulating the conditions of employment of workers in relation to whom the Committee operates :

AND WHEREAS the provisions of Section 43 of the Act have been complied with :

NOW, THEREFORE, the Court, in exercise of the powers conferred on it by Section 43 of the Act hereby orders as follows :—

(1) This Order may be cited as the Employment Regulation Order (Messengers (Cork City Area) Joint Labour Committee), 1953.

(2) Effect is hereby given to the proposals set out in the Schedule hereto.

(3) The proposals set out in the Schedule hereto shall have effect as from the 9th day of May, 1953, and as from that date the said Order shall be revoked.

SCHEDULE.

PART I

GENERAL MINIMUM TIME RATES

The following rates shall be the minimum time rates payable :—

PART II

NORMAL WORKING HOURS AND OVERTIME RATES

Section 1.—The normal number of hours to be worked by workers in relation to whom the Committee operates shall be as follows :—

In any week	46 hours
On four days in each week	8 "
On one day in each week	9 "
On the short day in each week	5 "

An interval of 1¼ hours to be allowed for a meal on all days other than the short day.

Section II.—The Minimum Rates for Overtime to apply in respect of hours worked by workers in excess of the declared normal number of hours of work shall be as follows:—

(i) For the first two hours of overtime on any day in excess of the declared normal number of hours—Time-and-a-Quarter of the rate otherwise applicable.

(ii) For all overtime in excess of the first two hours—Time-and-a-Half of the rate otherwise applicable.

(iii) For all hours worked on Sundays and Customary Public or Statutory Holidays—Twice the rate otherwise applicable, i.e. Double Time, subject to a minimum payment of 2s.

PART III

CASUAL WORKERS

The rates for workers employed on a casual basis (i.e. other than on a weekly basis) shall be Time-and-a-Half of the rates otherwise applicable to their age group.

PART IV

HOLIDAYS AND HOLIDAY REMUNERATION

Workers in relation to whom the Committee operates and who qualify for annual leave under Section 10 of the Holidays (Employees) Act, 1939 , shall in addition to the seven consecutive whole holidays prescribed therein be granted a further period of seven consecutive whole holidays, and the payment in respect of this further period shall be calculated in the same manner as that for the statutory period provided by that Act.

PART V

PROTECTIVE CLOTHING

It shall be the duty of the employer to provide protective clothing such as capes, pull-ups and souwesters for messengers employed by him.

It shall be the duty of workers to take reasonable care of the protective clothing provided.

PART VI

DEFINITION OF WORKERS

The above Statutory Minimum Remuneration and Conditions of Employment shall apply, subject to the provisions of the Industrial Relations Act, 1946 , to all workers under twenty years of age wholly or mainly engaged in the delivery of goods and employed by persons whose place of business is situate within a radius of three miles from the Head Post Office in the County Borough of Cork.
