S.I. No. 69/1953 - Coras Iompair Eireann (Naas - Corbally Canal) Order, 1953.


WHEREAS Córas Iompair Éireann applied on the 9th day of May, 1952 to the Transport Tribunal for an Order pursuant to Section 56 of the Transport Act, 1950 (No. 12 of 1950) in respect of that part of the Grand Canal between Naas and Corbally in the County of Kildare specified in the Schedule hereto which has not been used for public navigation for ten years past:

AND WHEREAS Notice of said application was duly published in the manner and at the times directed by the said Tribunal :

AND WHEREAS an objection by an interested party to the making of the Order applied for was received by the said Tribunal but such objection was subsequently withdrawn :

NOW, WE, THE TRANSPORT TRIBUNAL, in exercise of the powers conferred on us by Section 56 of the Transport Act, 1950 (No. 12 of 1950), hereby order as follows :—

1. This Order may be cited as the Córas Iompair Éireann (Naas—Corbally Canal) Order, 1953.

2. This Order shall come into operation on the 28th day of February, 1953.

3. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

4. Córas Iompair Éireann is hereby released from the obligation to keep open for navigation the part of the Grand Canal specified in the Schedule hereto.

SCHEDULE.

That part of the Grand Canal extending from Naas to Corbally in the County of Kildare known as the Herbertstown branch of the Grand Canal.
