EMPLOYMENT REGULATION ORDER (CREAMERIES JOINT LABOUR COMMITTEE), 1952.

WHEREAS the Labour Court (hereinafter called " the Court "), pursuant to the provisions of Section 43 of the Industrial Relations Act, 1946 (hereinafter called " the Act "), made the Employment Regulation Order (Creameries Joint Labour Committee), 1949 (hereinafter called " the Principal Order ") fixing the minimum rates of remuneration to be paid generally to and regulating the conditions of employment of workers in relation to whom the Creameries Joint Labour Committee (hereinafter called " the Committee ") operates ;

AND WHEREAS the Court, pursuant to the same Section of the Act, has also made the Employment Regulation Order (Creameries Joint Labour Committee), 1950 (hereinafter called " the first Amending Order ") and the Employment Regulation Order (Creameries Joint Labour Committee), 1951 (hereinafter called " the second Amending Order ") amending the principal Order ;

AND WHEREAS the Committee has submitted to the Court the proposals set out in the Schedule hereto for fixing the minimum rates of remuneration to be paid generally to workers in relation to whom the Committee operates ;

AND WHEREAS the provisions of Section 43 of the Act have been complied with ;

NOW THEREFORE, the Court in exercise of the powers conferred on it by Section 43 of the Act hereby orders as follows :—

(1) This Order may be cited as the Employment Regulation Order (Creameries Joint Labour Committee), 1952.

(2) Effect is hereby given to the proposals set out in the Schedule hereto.

(3) The proposals set out in the Schedule hereto shall have effect as from the 26th day of September, 1952, and as from that date the second Amending Order shall be revoked and the Principal Order shall be amended by the substitution of Part I of the Schedule hereto for Part I of the Schedule to the Principal Order as amended by the first Amending Order.

SCHEDULE.

PART I.

STATUTORY MINIMUM REMUNERATION FOR A NORMAL WORKING WEEK AS DEFINED IN PART II OF NOTICE C. (N.4).

SECTION 1.—Workers employed in Central Creameries.

A Maintenance Mechanic or Fitter is a person wholly or mainly employed on the repair or upkeep of machinery (not including a mechanic's helper or a fitter's helper).

A Buttermaker is a person wholly or mainly employed in the process of making butter, who is certified by the Department of Agriculture as a qualified Buttermaker, and who is in full charge of the Buttermaking Department.

(c) Cheesemaker

A Cheesemaker is a person wholly or mainly employed in the process of making cheese, who is certified by the Department of Agriculture as a qualified Cheesemaker, and who is in full charge of the Cheesemaking Department

(d) Assistant Buttermaker

An Assistant Buttermaker is a person wholly or mainly employed in the process of making butter, and who is certified by the Department of Agriculture as a qualified Buttermaker, but who is not in full charge of the Buttermaking Department.

(e) Assistant Cheesemaker

An Assistant Cheesemaker is a person wholly or mainly employed in the process of making cheese, and who is certified by the Department of Agriculture as a qualified Cheesemaker, but who is not in full charge of the Cheesemaking Department.

(f) Engineman, Fireman, Boilerman, Mechanic's Helper and Fitter's Helper (wholly or mainly employed as such)

(g) Lorry Driver

A Lorry Driver is a person wholly or mainly employed in driving (including loading and unloading) a mechanically propelled road haulage vehicle, or a vehicle licensed by the Minister for Agriculture under Section 3 of the Dairy Produce (Amendment) Act, 1934 , to carry on Cream separating business.

(h) All other Female Workers, other than Apprentice Buttermakers or Apprentice Cheesemakers selected by the Department of Agriculture, not included in any of the classes (a) to (g) above.

SECTION III.—Additional Payment for Sunday Work.

In addition to any other payment due under this Order or any other Employment Regulation Order a worker shall be paid 1/3d. per hour for all hours worked on a Sunday subject to a maximum payment of 5/- for any one Sunday.
