CREAMERY BUTTER (LEVY) ORDER, 1952.

I, THOMAS WALSH, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and of every and any other power me in this behalf enabling, do by this Order make the following regulations :—

1. This Order may be cited as the Creamery Butter (Levy) Order, 1952.

2. The Creamery Butter (Levy) (No. 2) Order, 1951 ( S.I. No. 175 of 1951 ), is hereby revoked as on and from the 5th day of July, 1952.

3. In this Order—

the expression " butter (wholesale) dealer " means a person who carries on the business of selling creamery butter by wholesale only and shall include a society registered under the Industrial and Provident Societies Acts, 1893 to 1936, which was at any time the registered proprietor of premises registered in the register of creameries kept in pursuance of the Dairy Produce Act, 1924 (No. 58 of 1924), but does not include a company which purchases creamery butter mainly for resale to another company any of the shares in which is held by such first-mentioned company or by any person who is a shareholder in such first-mentioned company.

4. The rate of levy on creamery butter manufactured on or before the 4th day of July, 1952, other than creamery butter sold on or before the 4th day of July, 1952, shall be:—

(a) on butter made up in rolls—

(i) where the quantity sold equals or exceeds 10 cwt., 92/6d. per cwt. ;

(ii) where the quantity sold is less than 10 cwt., 93/-per cwt. ;

(b) on butter not made up in rolls which is sold to the proprietor of a creamery or a butter (wholesale) dealer—

(i) where the quantity sold equals or exceeds 20 cwt., 90/6d. per cwt.

(ii) where the quantity sold is less than 20 cwt. 9¼d. per cwt.

(c) on butter not made up in rolls which is sold to a purchaser other than the proprietor of a creamery or a butter, (wholesale) dealer—

(i) where the quantity sold equals or exceeds 20 cwt., 94/4d. per cwt. ;

(ii) where the quantity sold is less than 20 cwt., 92/4d. per cwt.

5. The rate of levy on creamery butter manufactured on or after the 5th day of July, 1952, shall be :—

(a) on butter made up in rolls and on butter, whether made up in rolls or not, which is sold to the proprietor of a creamery or a butter (wholesale) dealer, 4d. per cwt. ;

(b) on butter not made up in rolls which is sold to a purchaser other than the proprietor of a creamery or a butter (wholesale) dealer ;

(i) where the quantity sold equals or exceeds 20 cwt., 4/2 per cwt. ;

(ii) where the quantity sold is less than 20 cwt., ¼ per cwt.
