IRISH NATIONALITY AND CITIZENSHIP REGULATIONS, 1939 (AMENDMENT) REGULATIONS, 1952.

I, GERALD BOLAND, Minister for Justice, in exercise of the powers conferred on me by the Irish Nationality and Citizenship Act, 1935 (No. 13 of 1935), and of every and any other power me in this behalf enabling, hereby make the following regulations :—

1. These Regulations may be cited as the Irish Nationality and Citizenship Regulations, 1939 (Amendment) Regulations, 1952.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The Irish Nationality and Citizenship Regulations, 1939 (S. R. & O., No. 16 of 1939), are hereby amended by the substitution for Article 16 of the following Article :—

" 16. Every declaration (other than a declaration of retention of Irish citizenship under subsection (3) of section 2 of the Act) made under the Act and mentioned in these Regulations shall—

(a) if made in the national territory, be made before a notary public or a commissioner for oaths or a peace commissioner, and

(b) if made in any place other than the national territory, be made before any of the following persons—

(i) the Head of the Irish Diplomatic Mission for the the Mission, or

(ii) an officer of that Mission authorised by the Head of the Mission, or

(iii) any diplomatic or consular officer of Ireland entitled by law to administer any oath and take any affidavit, or

(iv) a notary public, or

(v) any person who is, by the law of the country in which the declaration is made, a commissioner for oaths or other person authorised to take affidavits and for that purpose to administer oaths ".
