WE, the Superior Courts Rules Committee constituted pursuant to the provisions of Section 67 of the Courts of Justice Act, 1936 , by virtue of the powers conferred upon us by Section 36 of the Courts of Justice Act, 1924 , and Section 68 of the Courts of Justice Act. 1936 , and of all other powers enabling us in this behalf, do hereby make the annexed Rules or Court.

1. These rules may be referred to as the High Court Rules, 1951, and shall be read with the existing rules of the High Court and Supreme Court and shall be deemed to be incorporated therewith, but shall, so far as inconsistent therewith, amend or alter the said rules accordingly.

2. The fees in Appendix S. Part III, Section XIV, of the Rules of the Supreme Court (Ireland), 1905, as amended by Order in Council made on 1st July, 1920, shall be deleted and the following shall be substituted therefor as the fees payable to Commissioners of the Court in non-contentious Probate matters :—

3. Appendix 2, Part 1, of the Rules of the High Court and Supreme Court, 1926, as amended by the High Court Rules (No. 2), 1947, shall be amended as follows :—

5. The expression " The existing rules of the High Court and Supreme Court " shall include the Rules of the Supreme Court (Ireland), 1905, as amended by any subsequent Orders in Council, and all rules of the High Court and Supreme Court made under the Courts of Justice Acts, 1924 to 1936.

ADMIRALTY.

6. The powers, authorities, duties and functions formerly exercised and performed by the Admiralty Marshal shall henceforth be exercised and performed by such Officer of the High Court serving in the Central Office as the Officer having the management of that Office shall from time to time direct.
