LIMERICK HARBOUR WORKS ORDER, 1951.

I, SEÁN F. LEMASS Minister for Industry and Commerce, in exercise of the powers conferred on me by Part VIII of the Harbours Act, 1946 (No. 9 of 1946), and on the application of the Limerick Harbour Commissioners, hereby order as follows :—

1. This Order may be cited as the Limerick Harbour Works Order, 1951.

2. In this Order—

the expression " the Minister " means the Minister for Industry and Commerce ;

the expression " the Commissioners " means the Limerick Harbour Commissioners ;

the expression " local authority " has the same meaning as it has in the Local Government Act, 1941 (No. 23 of 1941) ;

the expressions " the plans ", " sections " and " specifications " mean the plans, sections and specifications deposited by the Commissioners with the Minister in connection with their application for this Order ;

the expression " the works " means the works authorised by this Order.

3. (1) The Commissioners are hereby authorised to carry out and complete in Limerick Harbour, in accordance with the plans, sections and specifications and subject to paragraph (3) of this Article, Work No. 1 and Work No. 2.

(2) In this Article—

the expression " Work No. 1 " includes the work necessary to complete the new western entrance to Limerick Dock, including the building in steel sheet piling and reinforced concrete of the South Approach Jetty approximately 696 feet long and the North Approach Jetty and Roundhead approximately 589 feet long, the erection of new cellular steel dock gates and their operating machinery, and of new sluices and their operating machinery in the new gate chamber, the dredging to a level of -9·00" O.D. of an approach channel to the new entrance to give a depth of 26·25' at H.W.O.S.T., the lowering by dredging of the bottom of the wet dock to a level of -9·00' O.D. to give a uniform depth of 26·25' at H.W.O.S.T. and the closing of the eastern Dock entrance by the building of concrete quay walls across the existing opening and filling up to the level of the quay roadway together with all auxiliary works pertaining thereto ;

the expression " Work No. 2 " includes the dredging of the bed of the navigable channel of the River Shannon from the termination of Work No. 1 at Limerick Dock to a line drawn due north through Beigh Quay in County Limerick, a distance of approximately 14 statute miles, where required, to provide sufficient depth of water for vessels drawing 24"6" to navigate to and from Limerick, and the making and erecting of all necessary moorings, dolphins, stagings, platforms, jetties, embankments, water courses, drains, sluices, and pipe lines for the purpose of such dredging or for the purpose of disposing of the materials so dredged, the erection of 5 lighted beacons and 2 lighted buoys and 2 unlighted buoys in the North Channel of the River Shannon as aids to navigation and the conversion of thirteen existing river navigation lights from oil lighted to automatic gas lighted flashers together with all auxiliary works pertaining thereto.

(3) In executing the works the Commissioners may, with the consent in writing of the Minister, deviate laterally to any extent within the limits of deviation marked on the plans and may with the like consent deviate vertically to any extent from the levels of the works as shown on the sections.

4. The works shall be completed within 10 years from the commencement of this Order.

5. Nothing in this Order shall authorise any interference except by consent of the Minister for Posts and Telegraphs with any telegraphic lines of the Minister for Posts and Telegraphs as defined by the Telegraph Acts, 1863 to 1928, or other property of the Minister for Posts and Telegraphs or any of the rights of the Minister for Posts and Telegraphs under the said Acts.

6. All costs, charges, fees and expenses of or incidental to preparing and obtaining this Order or otherwise incurred in relation thereto shall be paid by the Commissioners out of their funds.
