S.I. No. 174/1950 - Garda Síochána Allowances Order, 1950.


WHEREAS it is enacted by subsection (1) of section 12 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), that the Minister for Justice may, with the sanction of the Minister for Finance, from time to time by order regulate and appoint the rates of pay and allowances (including conditions applicable thereto) to be paid to the several ranks and to the several grades of each rank of the officers and men of the Garda Síochána :

AND WHEREAS it is enacted by subsection (2) of the said section 12 that before making an order under that section the Minister for Justice shall cause the draft of the order to be submitted to the several representative bodies representing the several ranks and grades of the Garda Síochána who would be affected by the Order when made and shall consider any representations made to him in respect of the draft order by any such representative body :

AND WHEREAS before making this Order the Minister for Justice duly caused the draft thereof to be submitted to the several representative bodies representing the several ranks and grades of the Garda Síochána who would be affected by this Order when made and has considered the representations made to him in respect of the said draft order by such representative bodies :

NOW, the Minister for Justice, in exercise of the powers conferred on him by section 12 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and of every and any other power him in this behalf enabling, and with the sanction of the Minister for Finance testified by his official seal affixed hereto hereby orders as follows :—

1. (1) This Order may be cited as the Garda Síochána Allowances Order, 1950.

(2) The Garda Síochána Allowances Orders, 1947 and 1949, and this Order may be cited together as the Garda Síochána Allowances Orders, 1947 to 1950.

2. In this Order the expression " the Principal Order " means the Garda Síochána Allowances (Consolidation) Order, 1947 ( S. R. & O. No. 167 of 1947 ), as amended by the Garda Síochána Allowances Order, 1949 ( S.I. No. 344 of 1949 ).

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. (1) The several amounts, payable as rent allowance, mentioned in paragraph (1) of Article 4 of the Principal Order (other than the amounts of £36, £17 and £26) are hereby increased by 10 per cent.

(2) This Article shall be deemed to have come into operation on the 1st day of April, 1950.

5. The following paragraph shall be substituted for paragraph (5) of Article 4 of the Principal Order :

" (5) For the purposes of this Order, a widower shall be regarded as a married man, if, and for so long as, his child or any of his children remains under the age of (in the case of a male) 18 years or (in the case of a female) 21 years. Where a widower ceases by virtue of the foregoing provision of this paragraph, to be regarded as a married man, the Minister, with the consent of the Minister for Finance, may, notwithstanding the said provision, authorise payment of rent allowance, if, and for so long as, he is satisfied that the circumstances of the case warrant such a procedure."

6. Article 7 of the Principal Order is hereby amended by the addition to paragraph (3) of the following—

" Notwithstanding the foregoing provision of this paragraph, locomotion allowance shall not be paid to a Superintendent or an Inspector for whom official transport is provided or whose duties do not require him to incur travelling expenses in the performance of those duties."

7. The Sixth Schedule to the Principal Order is hereby amended by the deletion of all matter therein except the words " Passage West ".

8. Where an allowance under the Principal Order as amended by this or any subsequent Order is claimed, such allowance shall not, unless the Minister for Justice otherwise determines, be payable in respect of any period not falling wholly within twelve months immediately preceding the date on which it is claimed.
