DUBLIN DISTRICT MILK BOARD (MINIMUM PRICES FOR MILK) ORDER, 1950.

WHEREAS a determination of the Dublin District Milk Board under section 42 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), was communicated to the Minister for Agriculture and has been considered by him.

NOW, I, JAMES M. DILLON, Minister for Agriculture, in exercise of the powers conferred on me by sub-paragraph (i) of paragraph (b) of sub-section (1) of section 43 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Dublin District Milk Board (Minimum Prices for Milk) Order, 1950, and shall come into operation on the 1st day of May, 1950.

2. In this Order—

the expression " registered producers " means persons registered in the register of producers kept by the Dublin District Milk Board ;

the expression " registered retailers " means persons registered in the register of retailers kept by the Dublin District Milk Board ;

the expression " registered wholesalers " means persons registered in the register of wholesalers kept by the Dublin District Milk Board ;

the expression " collecting place " means a place other than the producer's registered premises at which milk is delivered by mutual agreement between the producer and the purchaser.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. The Dublin District Milk Board (Minimum Prices for Milk) Order, 1949 ( S.I. No. 108 of 1949 ) is hereby revoked.

5. The minimum prices to be paid to registered producers for milk sold by them to registered wholesalers and retailers shall be at the following rates :—

(1) where the milk is delivered during the months of May to September inclusive—

(a) if the milk is delivered at the registered premisesof the purchaser, one shilling and eight pence per gallon ;

(b) if the milk is delivered, in the case of a registered wholesaler or retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler or retailer, at the railway station nearest to such wholesaler's or retailer's registered premises, one shilling and seven pence three farthings per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, one shilling and seven pence per gallon,

(ii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, one shilling and sixpence three farthings per gallon ;

(iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, one shilling and sixpence halfpenny per gallon ;

(iv) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and sixpence farthing per gallon.

(v) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, one shilling and sixpence per gallon.

(2) where the milk is delivered during the months of October to March inclusive—

(a) if the milk is delivered at the registered premises of the purchaser, two shillings and sixpence per gallon ;

(b) if the milk is delivered, in the case of a registered wholesaler or retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler or retailer, at the railway station nearest to such wholesaler's or retailer's registered premises, two shillings and fivepence three farthings per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, two shillings and fivepence per gallon ;

(ii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, two shillings and fourpence three farthings per gallon ;

(iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, two shillings and fourpence halfpenny per gallon ;

(iv) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, two shillings and fourpence farthing per gallon ;

(v) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, two shillings and fourpence per gallon.

(3) where the milk is delivered during the month of April—

(a) if the milk is delivered at the registered premises of the purchaser, one shilling and ninepence per gallon ;

(b) if the milk is delivered, in the case of a registered wholesaler or retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler or retailer, at the railway station nearest to such wholesaler's or retailer's registered premises, one shilling and eightpence three farthings per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, one shilling and eightpence per gallon ;

(ii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, one shilling and sevenpence three farthings per gallon ;

(iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises, exceeds twenty miles, but does not exceed thirty miles, one shilling and sevenpence halfpenny per gallon ;

(iv) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and sevenpence farthing per gallon ;

(v) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, one shilling and sevenpence per gallon.
