FACTORY AND WORKSHOP ACT, 1901. CERTIFYING SURGEONS (FEES) ORDER, 1950.

The Minister for Industry and Commerce, in exercise of the powers conferred on him by section 124 of the Factory and Workshop Act, 1901, and of every and any other power him in this behalf enabling hereby orders as follows :—

1.—(1) This Order may be cited as the Certifying Surgeons (Fees) Order, 1950.

(2) This Order shall come into operation on the 1st day of February, 1950.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

3. The scale of fees set out in Table I to this Order shall be substituted for the scale of fees set forth in Part I of the Fifth Schedule to the Factory and Workshop Act, 1901, as amended by the Fees of Certifying Surgeons for Examinations for Certificate of Fitness Order, dated 9th March, 1920.

4. The scale of fees set out in Table II to this Order shall be substituted for the scale of fees payable to Certifying Surgeons under the Secretary of State's Order of the 17th April, 1920, in respect of examination made in pursuance of Regulations of Special Rules.

TABLE I.

When the examination is at the factory or workshop.

3s. for each person examined with a minimum fee of 7s. 6d. for any one visit, and also if the factory or workshop is more than one mile from Surgeon's central point, 9d. for each complete half-mile over and above the mile.

When the examination is not at the factory or workshop but at the residence of the Surgeon or at some place appointed by the Surgeon for the purpose, and that place as well as the day and hour appointed for the purpose has been published in the prescribed manner.

3s. for each person examined.

TABLE II.

For each visit, including such examinations, entries in registers, issue of Certificates and other duties as may be required by Regulations or Special Rules, (a) when the examination is at a factory or workshop within a mile from the Certifying Surgeon's central point, 3s. for each person examined, with a minimum fee of 7s. 6d. for any one visit ; (b) when the examination is at a factory or workshop more than one mile from the Surgeon's central point, the above fees with an additional 1s. 6d. for each mile or portion of a mile beyond the first mile.
