IMPORTATION OF TEA ORDER, 1950.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)) and of every and any other power me in this behalf enabling, hereby order as follows :—

1. This Order may be cited as the Importation of Tea Order, 1950.

2. In this Order the expression " the Minister " means the Minister for Industry and Commerce ; the word " licence " means a licence issued by the Minister under this Order authorising the importation of tea.

3. (1) Any person may apply to the Minister for a licence and every such application shall—

(a) be in writing, and

(b) be sent to the Secretary, Department of Industry and Commerce, Dublin.

(2) On receipt of an application duly made under paragraph (1) of this Article, the Minister may, in his discretion, grant or refuse the application.

(3) The Minister may attach to a licence any conditions which he considers proper, including, in particular, conditions as to the disposal by the licensee of the tea to which the licence relates.

(4) Where any condition is attached to a licence, the licensee shall comply with the condition.

4. (1) On and after the 7th March, 1950, no person shall import any tea unless—

(a) he is the licensee under a licence issued in respect of the tea, and

(b) the tea is imported in accordance with the licence, and

(c) the licence is delivered at the time of the importation to the proper officer of Customs and Excise.

(2) The following shall be exempted from the prohibition effected by paragraph (1) of this Article—

(a) tea not exceeding two pounds in weight which is shown to the satisfaction of the Revenue Commissioners to be imported for the personal use of the person by whom it is imported or of his household, and

(b) tea which is shown to the satisfaction of the Revenue Commissioners to be imported as a sample.
