RETURNING OFFICERS' (BOROUGH AND COUNTY CONSTITUENCIES) BYE-ELECTION CHARGES ORDER, 1948.

The Minister for Finance, in exercise of the powers conferred on him by sub-section (5) of section 25 of the Electoral Act, 1923 (No. 12 of 1923), and of every and any other power him in this behalf enabling, hereby orders as follows :—

1.—(1) This Order may be cited as the Returning Officers' (Borough and County Constituencies) Bye-Election Charges Order, 1948.

(2) The Returning Officers' (Borough and County Constituencies) Bye-Election Charges Order, 1938 ( S. R. & O. No. 142 of 1938 ), and this Order may be cited together as the Returning Officers' (Borough and County Constituencies) Bye-Election Charges Orders, 1938 and 1948.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order the expression " the Schedule " means the Schedule to the Returning Officers' (Borough and County Constituencies) Bye-Election Charges Order, 1938 ( S. R. & O. No. 142 of 1938 ).

4. The Schedule is hereby amended by the deletion of the definition of the word " constituency " and the substitution of the following definition :

" the word 'constituency ' means any constituency named in the First Schedule to the Electoral (Amendment) Act, 1947 (No. 31 of 1947)."

5. References in the Schedule to the scale of Returning Officers' Charges made on the 17th day of June, 1937, shall be construed as references to the scale prescribed by the Returning Officers' (Borough and County Constituencies) Charges Orders, 1937 to 1948.

6. The Schedule is hereby amended by the deletion of the portion beginning " (i) To the returning officer or the assistant returning officer " and ending " for the purposes of the foregoing provision of this scale " and the substitution of the following :

" (i) To the returning officer or the assistant returning officer for conducting the bye-election and generally performingall the duties which a returning officer is required by law to perform :

As respects a county constituency—

For every complete 100 of the electors for the constituency

As respects a borough constituency—

For every complete 100 of the electors for the constituency :

up to 75,000 electors

For the purposes of the foregoing—

(a) where, at any time, a returning officer conducts bye-elections, in more than one borough constituency, those bye-elections shall be deemed to be a single bye-election and those constituencies shall be deemed to be a single borough constituency ;

(b) where, at any time, a returning officer conducts more than one bye-election in the same borough constituency, those bye-elections shall be deemed to be a single bye-election and the number of electors shall be deemed to be the actual number of electors in the constituency multiplied by the actual number of such bye-elections."
