BICYCLES (MAXIMUM PRICES) ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947 (No. 39 of 1947)), and of every and any other power me in this behalf enabling, hereby order as follows :—

1.—(1) This Order may be cited as the Bicycles (Maximum Prices) Order, 1948.

(2) This Order shall come into operation on the 29th day of November, 1948.

2. Reference in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3.—(1) No person shall sell any description of pedal bicycle (except a tandem bicycle) at a price exceeding the appropriate price indicated in respect of such bicycle in the First Schedule hereto except as provided in paragraph (2) of this article.

(2) In the case of a sale of a pedal bicycle equipped with one or more of the descriptions of equipment mentioned in the second column of the Second Schedule hereto the appropriate price of such bicycle as set out in the First Schedule hereto may be increased :—

(a) where the pedal bicycle is equipped with only one of the said descriptions of equipment by an amount not exceeding the appropriate amount set out in the third column of the Second Schedule hereto, or

(b) where the pedal bicycle is equipped with more than one of the said descriptions of equipment by an amount not exceeding the sum of the appropriate amounts set out in the third column of the Second Schedule hereto.

4. Where a direction is given by the Minister for Industry and Commerce in respect of any particular person or group of persons or in respect of any particular pedal bicycle or pedal bicycles the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction.

5. Emergency Powers (Bicycles) (Maximum Prices) Order, 1946 (S. R. & O. No. 192 of 1946) and Emergency Powers (Bicycles) (Maximum Prices) Order, 1946 (Amendment) (No. 1) Order, 1946 (S. R. & O. No. 355 of 1946) and Emergency Powers (Bicycles) (Maximum Prices) Order, 1946 (Amendment) (No. 2) Order, 1947 (S. R. & O. No. 28 of 1947) are hereby revoked as from the 29th day of November, 1948.
