DISTRIBUTION OF TEA TO CATERING ESTABLISHMENTS AND INSTITUTIONS ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), hereby order as follows :—

1.—(1) This Order may be cited as the Distribution of Tea to Catering Establishments and Institutions Order, 1948.

(2) This Order shall come into operation on the 1st day of June, 1948.

2. In this Order—

the expression " licensed tea retailer," " catering establishment" and " institution " have the same respective meanings as in the Emergency Powers (Retail Distribution of Tea) Order, 1943 (S. R. & O. No. 60 of 1943) ;

the expression " the standard year " means the period of twelve months ended on the 30th day of June, 1939 ;

the expression " 1938-39 catering establishment " means a catering establishment at which business was carried on during the whole of the standard year ;

the expression " 1938-39 institution " means an institution which was in existence during the whole of the standard year.

3.—(1) Where, during the standard year, a licensed tea retailer sold tea by retail to the proprietor of a 1938-39 catering establishment as such, he may sell by retail to the proprietor of that catering establishment as such during the month of June, 1948 and each succeeding month a quantity of tea not exceeding one and one-third times the quantity sold by him to the proprietor of that catering establishment as such in the month of May, 1948.

(2) Where, during the standard year, a licensed tea retailer sold tea by retail to the head of a 1938-39 institution as such, he may sell by retail to the head of that institution as such during the month of June, 1948, and each succeeding month a quantity of tea not exceeding one and one-third times the quantity sold by him to the head of that institution as such in the month of May, 1948.

4.—(1) Where, by virtue of paragraph (1) of Article 4 of the Emergency Powers (Distribution of Tea to Catering Establishments and Institutions) (No. 2) Order, 1946 (S. R. & O. No. 156 of 1946), alicensed tea retailer was authorised to supply during the month of May, 1948, a quantity of tea to the proprietor of a catering establishment as such, he may supply to the proprietor of that catering establishment as such during the month of June, 1948, and each succeeding month a quantity of tea not exceeding one and one-third times the first-mentioned quantity.

(2) Where, by virtue of paragraph (2) of Article 4 of the Emergency Powers (Distribution of Tea to Catering Establishments and Institutions) (No. 2) Order, 1946 (S. R. & O. No. 156 of 1946), a licensed tea retailer was authorised to supply during the month of May, 1948, a quantity of tea to the head of an institution as such, he may supply to the head of that institution as such during the month of June, 1948, and each succeeding month a quantity of tea not exceeding one and one-third times the first-mentioned quantity.

5. The provisions of this Order shall have effect notwithstanding anything contained in paragraph (1) of Article 18 of the Emergency Powers (Retail Distribution of Tea) Order, 1943 (S. R. & O. No. 60 of 1943).

6. The Emergency Powers (Distribution of Tea to Catering Establishments and Institutions) (No. 2) Order, 1946 (S. R. & O. No. 156 of 1946), is hereby revoked.
