S.I. No. 167 of 1948.

DUBLIN PORT SANITARY AUTHORITY (DISSOLUTION) ORDER, 1948.

The Minister for Health in exercise of the powers conferred on him by section 107 of the Health Act, 1947 , after consultation with the Minister for Local Government hereby orders as follows:—

1. In this Order—

the expression " the Health Authority " means the Lord Mayor, Aldermen and Burgesses of Dublin; and

the expression " the Port Sanitary Authority " means the Dublin Port Sanitary Authority.

2. The Port Sanitary Authority is hereby dissolved.

3.—(1) All property, rights and liabilities held, enjoyed or incurred by the Port Sanitary Authority shall be and are hereby transferred to the Health Authority and accordingly, without any further conveyance, transfer or assignment

(a) the said property shall vest in the Health Authority,

(b) the said rights shall be enjoyed by the Health Authority,

(c) the said liabilities shall be the liabilities of the Health Authority.

(2) All moneys transferred to the Health Authority by this Article which are standing in the books of any bank, corporation or company in the name of the Port Sanitary Authority shall, upon the request of the Health Authority, be transferred into the name of the Health Authority.

4. Where any legal proceedings are pending to which the Port Sanitary Authority is a party, the name of the Health Authority shall be substituted in the proceedings for that of the Port Sanitary Authority and the proceedings shall not abate by reason of such substitution.

5. The office of clerk to the Port Sanitary Authority held by Gerard Campbell is hereby abolished.

6. This Order may be cited as the Dublin Port Sanitary Authority (Dissolution) Order, 1948.
