S.I. No. 101 of 1948.

HEALTH ACT, 1947 (ADAPTATION) ORDER, 1948.

The Minister for Health in exercise of the powers conferred on him by Section 109 of the Health Act, 1947 (No. 28 of 1947), hereby orders as follows : :—

1. This Order may be cited as the Health Act, 1947 (Adaptation) Order, 1948.

2. In paragraph (a) of subsection (1) and in subsection (7) of section 3 of the Housing (Amendment) Act, 1946 (No. 2 of 1946) the words " Health Act, 1947 " shall be substituted for the words " Tuberculosis Prevention (Ireland) Acts, 1908 and 1913 ".

3. In the regulations made by the Local Government Board for Ireland on the 21st day of January, 1908 relating to (a) Cholera, Yellow Fever and Plague (Ships arriving from Foreign Ports), (b) Cholera and Plague (Ireland-Coasting Ships) and (c) Cholera and Plague (Outward Bound Ships: Specified Articles) and in the Public Health (Deratisation of Ships) Regulations, 1930, references to a sanitary authority shall be construed as references to the health authority within the meaning of the Health Act, 1947 whose functional area includes or abuts on any part of a customs port and references to a medical officer of health shall be construed as references to the chief medical officer, within the meaning of the Health Act, 1947 , of such health authority.

4. The following adaptations shall be made in the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1947 (S. R and O., 1947, No. 58):—

(a) In paragraph 2 of the Second Schedule, the words "health inspector " shall be substituted for the words " sanitary inspector ".

(b) The following sub-paragraph shall be substituted for sub-paragraphs (d), (e), (f) and (g) of paragraph 5 of the Second Schedule :—

" (d) Part III or IV of the Health Act, 1947 (No. 28 of 1947) "

5. The Schedule to the Local Government (Officers) Regulations, 1943 (S. R. & O., 1943, No. 161) shall be adapted by substituting for the references therein to the Tuberculosis (Ireland) Acts, 1908 and 1913, the Public Health (Medical Treatment of Children) (Ireland) Act, 1919 and the Public Health (Prevention and Treatment of Disease) (Ireland) Act, 1917, a reference to the Health Act, 1947 .
