THE BOOT AND SHOE REPAIRING JOINT LABOUR COMMITTEE EMPLOYMENT REGULATION ORDER, 1947.

THE LABOUR COURT.

INDUSTRIAL RELATIONS ACT, 1946 .

SUBMISSION having been made to the Labour Court by the Boot and Shoe Repairing Joint Labour Committee of the proposals set out in the Schedule hereto for fixing the minimum rates of remuneration and regulating the conditions of employment of workers in relation to whom the Committee operates thereby amending the Order of the Minister for Industry and Commerce confirming the variation of Minimum Rates of Wages for Male and Female workers in relation to whom the Committee operates dated the 4th day of July, 1946, and made under the provisions of the Trade Boards Acts, 1909 and 1918, which order is deemed to be an Employment Regulation Order by virtue of the provisions of Section 54 of the Industrial Relations Act, 1946 ,

THE LABOUR COURT, the provisions of section 43 of the Industrial Relations Act, 1946 , having been complied with, by virtue of the powers conferred upon it by the said section 43, HEREBY ORDERS as follows :—

1. This Order may be cited as the Boot and Shoe Repairing Joint Labour Committee Employment Regulation Order, 1947.

2. Effect is hereby given to the proposals set out in the Schedule hereto.

3. The provisions of the Schedule hereto shall have effect as from the 13th day of June, 1947, and as from that date the said Order of the Minister for Industry and Commerce dated the 4th day of July, 1946, shall be amended accordingly.

SCHEDULE.

STATUTORY MINIMUM REMUNERATION.

The Rates which shall apply to workers employed within the County Boroughs of Dublin, Cork, Limerick and Waterford, the Boroughs of Dun Laoghaire, Galway and Kilkenny, and the Urban District of Bray shall be the Rates set out hereunder.

The Rates which shall apply to workers employed within the Boroughs of Clonmel, Drogheda, Sligo and Wexford and the Urban Districts of Athlone, Carlow, Dundalk and Tralee shall be the Rates set out hereunder, subject to a reduction of 10 per cent.

The Rates which shall apply to workers employed in all other areas shall be the Rate set out hereunder, subject to a reduction of 20 per cent.

PART I.

Provided that the minimum rate payable to Male and Female Workers whose age is less than eighteen shall, for the first twelve months' employment in the trade, be a rate 25 per cent. less than the minimum rate otherwise applicable.

SECTION IV.—GENERAL MINIMUM TIME-RATES FOR MALE INDENTURED APPRENTICES.

Class A.

Male Apprentices who :—

(1) Are employed under an Indenture providing for the effective instruction of the Apprentice for a period of FOUR YEARS in Boot and Shoe Repairing in all its Branches, including rewelting, handsewn repairs, benching, and finishing by hand or machine ; and

(2) Are registered with the Joint Labour Committee in accordance with Rules from time to time laid down by the Joint Labour Committee.

Provided that an Apprentice of either Class A or Class B above, shall, on the completion of Four Years' Apprenticeship, be entitled to the General Minimum Time-Rate applicable to Adult Workers of 21 years of age and upwards, or on the attainment of 19 years, if this shall first happen, he shall thereupon be entitled to the General Minimum Time-Rate applicable to Workers between 19 and 20 years of age, and on the attainment of 20 years of age to the General Minimum Time-Rate applicable to Workers between 20 and 21 years of age, as set out in Part I Section II of this Schedule.

Class C.

Male Apprentices who :—

(1) Are employed under an Indenture providing for the effective instruction of the Apprentice for a period of Five Years in :—

(i) Handsewn making, or

(ii) Handsewn making and repairing, provided that not less than one-half of the Apprentice's time shall be spent in Handsewn making ; and

(2) Are registered with the Joint Labour Committee in accordance with Rules from time to time laid down by the Joint Labour Committee.

Provided that an Apprentice of Class C shall, on the completion of Five Years' Apprenticeship, be entitled to the General Minimum Time-Rate applicable to Adult Workers of 21 years of age and upwards, as set out in Part I., Section II of this Schedule.

Note.—All Apprentices other than the Indentured Apprentices specified in Classes A, B and C above shall be paid not less than the appropriate General Minimum Time Rates set out in Part I, Section II of this Schedule.

PART IV.

GENERAL MINIMUM PIECE-RATES FOR HOMEWORKERS, FOR REPAIRING OR MAKING.

The General Minimum Piece-Rates payable to Homeworkers (as defined in Part VII of Notice B.S. (N. 16)) for Repairing or Making, shall be those specified in Parts II and III, respectively, of this Schedule, With an Addition of 15 Per Cent. in each case.

PART V.

GUARANTEED TIME-RATE.

For Foremen, Forewomen or Managers (male or female) ... 132s. 9d. per week.

A foreman, forewoman or manager (male or female) employed on piece work must be paid at not less than the guaranteed time-rate in any case where his/her earnings on piece work are less than such rate.
