PUBLIC BODIES (TEMPORARY PROVISIONS) ORDER, 1947.

The Minister for local Government in exercise of the powers vested in him by the Local Government Acts, 1925 to 1946, and in exercise of every other power enabling him in this behalf hereby orders as follows :—

1. In this Order, the expression " the Principal Order " means the Public Bodies Order, 1946.

2. (1) This Order, in so far as it relates to the estimating or demanding of the expenses of any local authority or to the making of any rate, shall come into operation on the 30th day of November, 1947.

(2) The abstract of the accounts of a public body for the period ending on the 31st day of March, 1948, shall be prepared and certified in accordance with the provisions of the Principal Order.

(3) The following provisions shall have effect in relation to the opening of the accounts of a county council and an urban authority on the 1st day of April, 1948—

(a) the balance outstanding in the Health Services Account of a county council on the 31st day of March, 1948, shall be examined so as to ascertain the portion of the said balance which relates to services which are sanitary services. The portion of the said balance which relates to services which are sanitary services shall, on the 1st day of April, 1948, be transferred to the Sanitary Services Account and the remainder thereof shall be transferred to the Health Services Account ;

(b) the balance outstanding in the Health Services Account of an urban authority on the 31st day of March, 1948, shall be transferred to the Sanitary Services Account of such authority on the 1st day of April, 1948.

3. Subject to the provisions of sub-articles (1) and (2) of Article 2 of this Order, this Order shall come into force on the 1st day of April, 1948, and shall continue in force until such time as the Minister otherwise orders.

4. As long as this Order is in force, the Principal Order shall have effect with the amendments specified in the Schedule hereto.

5. This Order may be cited as the Public Bodies (Temporary Provisions) Order, 1947, and shall be construed as one with the Public Bodies Order, 1946.

SCHEDULE.

AMENDMENTS OF THE PRINCIPAL ORDER.

PART I.

1. In Article 2—

(a) For the definition of " health services ", there shall be substituted the following :—

" health services " means the functions of a county council or the corporation of a county borough under the Health Act, 1947 , the Midwives Act, 1944 , and sections 3 and 4 of the Housing (Amendment) Act, 1946 .

(b) After the definition of " health services ", there shall be inserted the following :—

" sanitary services " means the functions of a county council, a corporation of a county borough or an urban authority under the Public Health Acts, 1878 to 1931, the Baths and Wash-houses (Ireland) Act, 1845 or any enactment imposing on any such council, corporation or authority functions respecting any matter to which the said Acts relate.

(c) In the definition of " separate charge ", the words " joint district charges " shall be deleted.

(d) In the definition of " general purposes " there shall be inserted after the words " health services " the words " sanitary services ".

2. In Form A1 in the Schedule—

(a) The item Sanitary Services shall be inserted in the County Rate Account under the item Health Services.

(b) For the Health Services Account there shall be substituted the form set forth under that title in Part II of this Schedule.

(c) After the Health Services Account there shall be inserted the Sanitary Services Account in the form set forth under that title in Part II of this Schedule.

(d) There shall be inserted on the expenditure side of the General Purposes Account before the item seeds and fertilisers supply schemes, the following items :—

Milk and Dairies

School meals (Gaeltacht) :—

Cost of food

Administration

Blind Persons Act

(e) The item Public lighting shall be deleted from the expenditure side of the General Purposes Account.

(f) In the Revenue Account, Summary of Receipts and Expenditure, the word " Sanitary " shall be inserted under the word " Health ".

(g) The item Sanitary services shall be inserted under the item Health services on each side of the Statement of Balances.

3. In Form A2 in the Schedule—

(a) The item Health services shall be deleted from the Municipal Rate Account and the item Sanitary services substituted therefor.

(b) The Health Services Account shall be deleted and there shall be substituted therefor the Sanitary Services Account in the form set forth under that title in Part III of this Schedule.

(c) There shall be inserted on the expenditure side of the General Urban Purposes Account before the item Allotments the following items :—

Milk and Dairies

School meals ::—

Cost of food

Administration

(d) The item Public lighting shall be deleted from the expenditure side of the General Urban Purposes Account.

(e) In column (1) of the Summary of Receipts and Expenditure on Revenue Account, the word " Health " shall be deleted and the word " Sanitary " substituted therefor.

(f) The item Health services shall be deleted from each side of the Statement of Balances at Close of Year and the item Sanitary services substituted therefor.

4. In Form El in the Schedule—

(a) The entries in column 2 of Table A opposite the item Health in column 1 of the said table shall be deleted and there shall be substituted therefor the word " General ".

(b) Before the word " Housing " in Table A, the word " Sanitary " shall be inserted in column 1 of the said table and opposite thereto in column 2 the word " General " shall be inserted and thereunder the word " Total ".

(c) The entries in column 2 of Table B opposite the word " Health " in column 1 of the said table shall be deleted and there shall be substituted therefor the word " General ".

(d) Before the word " Housing " in Table B, the word " Sanitary " shall be inserted in column 1 of the said table and opposite thereto in column 2 the word " General " shall be inserted and thereunder the word " Total ".

(e) In column 1 of Table C before the word " Housing " the word " Sanitary " shall be inserted.

5. In Form E2 in the Schedule—

(a) The word " Health " shall be deleted from columns 1 and 2 of Table A and the word " Sanitary " substituted therefor.

(b) The word " Health " in column 1 of Table B shall be deleted and there shall be substituted therefor the word " Sanitary ".

(c) The word " Health " shall be deleted from column 1 of Table C and the word " Sanitary " substituted therefor.
