STATUTORY RULES AND ORDERS. 1947. No. 295.

REGISTER OF POPULATION ORDER, 1947.

The Government, in exercise of the powers conferred on them by the Supplies and Services (Temporary Provisions) Act, 1946 , and of every and any other power them in this behalf enabling, hereby order as follows, that is to say :—

1. This Order may be cited as the Register of Population Order, 1947.

2. In this Order—

the expression " the Minister " means the Minister for Industry and Commerce ;

the expression " the appointed time " means such time as the Minister may by order appoint ;

the word " prescribed " means prescribed by regulations made under this Order.

3. Subject to the provisions of this Order, there shall be established a register (in this Order referred to as the Register), to be called the Register of Population, of all persons in the State at the appointed time and there shall be entered in the Register, in relation to each person registered therein, his name and address, sex, age, condition as to marriage and such other particulars as may be prescribed.

4. The Minister shall make such arrangements and do such things as are necessary for the compilation of the Register in accordance with the provisions of this Order and of any regulations thereunder, and for that purpose shall make arrangements for the preparation and issue of the necessary forms and instructions and for the collection or reception of the forms when filled in.

5. For the purpose of compiling the Register, the Minister may make regulations providing for such matters as may be necessary or expedient, and in particular, but without prejudice to the generality of the foregoing—

(a) requiring persons employed under the regulations to make a statutory declaration with respect to the performance of their duties, and authorising any persons or class of persons therein mentioned to take such a declaration ;

(b) prescribing the persons or classes of persons by whom returns are to be made (whether as respects themselves or as respects other persons) the persons to whom returns are to be made and the form of the returns, and providing for the collection or delivery of the returns ;

(c) requiring the information necessary for the making of a return with respect to any person to be given either by that person, or by such other person as may be prescribed, to the person by whom the return is to be made.

6. The Minister may by regulations provide that the foregoing provisions of this Order and any regulations made thereunder shall not apply, or shall apply, subject to such exceptions and modifications as may be prescribed, to any particular class or classes of persons.

7.—(1) Every person who is required by regulations made under this Order to do a particular act or thing shall comply with such requirement.

(2) No person shall, in making any return or giving any information under regulations made under this Order, knowingly or recklessly make any statement which is false in any material respect.

8.—(1) No person employed under regulations made under this Order shall publish or communicate to any person, otherwise than in the ordinary course of such employment, any information acquired by him in the course of such employment.

(2) No person, having possession of any information which to his knowledge has been disclosed in contravention of paragraph (1) of this Article, shall publish or communicate that information to any other person.

(3) Nothing in the foregoing paragraphs of this Article shall apply to any publication or communication of information made—

(a) for the purposes of any criminal proceedings, or

(b) to any person authorised by the Minister.
