STATUTORY RULES AND ORDERS. 1947. No. 224.

CHEESE (MAXIMUM PRICES) ORDER, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)) and of every and any other power me in this behalf enabling, hereby order as follows :—

1.—(1) This Order may be cited as the Cheese (Maximum Prices) Order, 1947.

(2) This Order shall come into operation on the 25th day of June, 1947.

2. In this Order—

the expression " cheddar cheese " means cheese ordinarily known in the trade as " cheddar cheese ";

the expression " processed cheese " means cheese of any description which, after manufacture, has been heated and to which an emulsifying agent has been added ;

the word " truckle " means cheddar cheese manufactured as a whole cheese not exceeding 14 pounds in weight.

3. References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

4. No person shall sell cheddar cheese or processed cheese of any of the descriptions mentioned in the First or Second Schedule to this Order at a price exceeding a price calculated at the appropriate rate mentioned in the said First or Second Schedule opposite such description, provided that—

(a) when truckle is sold, an amount not exceeding four shillings and eightpence per hundredweight may be added to the prices shown in columns 3 and 4 of the First Schedule ;

(b) where a box (which formed part of a case and has been removed therefrom) of processed cheese is sold by a wholesale merchant, he may add to the appropriate price set out in column 4 of the Second Schedule an amount not exceeding ½d. per pound ;

(c) when a sale is made by a manufacturer or producer the prices shown in columns 3 and 4 of the First and Second Schedules shall be deemed to include the cost of delivery to the railway station nearest to the premises of the purchaser ;

(d) when a sale is made by other than a manufacturer or producer the prices shown in columns 3 and 4 of the First and Second Schedules shall be deemed to be f.o.r. prices.

5. The prices shown in column 5 of the Second Schedule to this Order shall apply to all sales of processed cheese whether packed in boxes or loose.

6. The Emergency Powers (Cheese) (Maximum Prices) Order, 1945 (S. R. & O. No. 148 of 1945) is hereby revoked.
