FIREWOOD (MAXIMUM PRICES) ORDER, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) ), and of every and any other power me in this behalf enabling, hereby order as follows :—

1.—(1) This Order may be cited as the Firewood (Maximum Prices) Order, 1947.

(2) This Order shall come into operation on the 27th day of February, 1947.

2.—References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3.—(1) No person shall sell any firewood at a price exceeding a price calculated at the appropriate rate set out in the Schedule hereto.

(2) No person shall sell firewood except by weight.

(3) No person shall sell a quantity of firewood which consists partly of firewood of the description set out in Part I of the Schedule hereto and partly of firewood of the description set out in Part II of the Schedule hereto.

4.—Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular firewood or classification of firewood, the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction.

5.—This Order shall not apply to wood which does not exceed eight inches in length and one inch in thickness and is used for kindling purposes.

6.—The Emergency Powers (Control of Prices) (No. 121) Order, 1942 (S. R. & O. No. 278 of 1942), the Emergency Powers (Control of Prices) (No. 121) Order, 1942 (Amendment) (No. 1) Order, 1943 (S. R. & O. No. 56 of 1943) and the Emergency Powers (Control of Prices) (No. 121) Order, 1942 (Amendment) (No. 2) Order, 1944 (S. R. & O. No. 125 of 1944) are hereby revoked.

SCHEDULE.

PART I.

Maximum prices for firewood when sold in blocks not exceeding ten inches in length and ten inches in diameter.

1. In the County Borough of Dublin and the Borough of Dún Laoghaire :

at the rate of 80/- per ton, delivered to consumers, except in the case of a sale of 4 stones or less, in which case a price calculated at the rate of 7d. per stone may be charged.

2. In—

(a) the county boroughs of Cork, Limerick and Waterford ;

(b) the urban district of Bray ;

(c) the administrative county of Dublin (excluding the borough of Dún Laoghaire) ;

(d) that portion of the administrative county of Cork which comprises (1) the following district electoral divisions, namely, Blackrock, Bishopstown, St. Mary's, Lehenagh and Douglas, and (ii) the townlands of Rathpeacon and Carhoo in the district electoral division of Whitechurch, the townlands of Arderrow, Ballyharoon, Banduff, Kilcully, Ballinamought East, Lahardane, Lota Beg and Lota More in the district electoral division of Rathcooney and the townland of Doughcloyne in the district electoral division of Inishkenny ; and

(e) that portion of the administrative county of Wicklow which comprises the following district electoral divisions, namely, Delgany, Enniskerry, Greystones, Kilmacanogue and Powerscourt—

at the rate of 70/- per ton, delivered to consumers, except in the case of a sale of 4 stones or less, in which case a price calculated at the rate of 6d. per stone may be charged.

3. In the remainder of the State—at the rate of 60/- per ton, delivered to consumers, except in the case of a sale of 4 stones or less, in which case a price calculated at the rate of 5d. per stone may be charged.

PART II.

Maximum prices for any other class of firewood.

1. In the county borough of Dublin and the borough of Dún Laoghaire—at the rate of 70/- per ton delivered to consumers.

2. In—

(a) the country boroughs of Cork, Limerick and Waterford ;

(b) the urban district of Bray ;

(c) the administrative county of Dublin (excluding the borough of Dún Laoghaire) ;

(d) that portion of the administrative county of Cork which comprises (i) the following district electoral divisions, namely, Blackrock, Bishopstown, St. Mary's, Lehenagh and Douglas, and (ii) the townlands of Rathpeacon and Carhoo in the district electoral division of Whitechurch, the townlands of Arderrow, Ballyharoon, Banduff, Kilcully, Ballinamought East, Lahardane, Lota Beg and Lota More in the district electoral division of Rathcooney and the townland of Doughcloyne in the district electoral division of Inishkenny ; and

3. In the remainder of the State— at the rate of 50/- per ton delivered to consumers.
