FLOUR AND BREAD (RATIONING) ORDER, 1946.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942), (which orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) ), and of every and any other power me in this behalf enabling, hereby order as follows :—

PART I.PRELIMINARY AND GENERAL.

1 Short title

1. This Order may be cited as the Flour and Bread (Rationing) Order, 1946.

2 Commencement

2. This Order shall come into operation on the 18th day of January, 1947.

3 Definitions

3. (1) In this Order—

authorised officer.

the expression " authorised officer " means a person who is an authorised officer for the purposes of the General Rationing Provisions Order ;

bread.

the word " bread " includes flour confectionery but does not include biscuits ;

bread retailer.

the expression " bread retailer " means a person who carries on the business of selling bread by retail ;

bread wholesaler.

the expression " bread wholesaler " means a person who carries on the business of selling bread by wholesale ;

catering establishment.

the expression " catering establishment " includes a restaurant, hotel, café, tea-room, canteen or club, but the said expression does not include a boarding house, guest house or lodging house ;

coupon.

the word " coupon " means a coupon which forms or formed part of a ration book ;

flour.

the word " flour " means the products produced by the milling of wheat and includes wheatmeal but does not include semolina or wheat offals ;

flour retailer.

the expression " flour retailer " means a person who carries on the business of selling flour by retail ;

flour wholesaler.

the expression " flour wholesaler " means a person who carries on the business of selling flour by wholesale ;

general ration book.

the expression " general ration book " means a general ration book within the meaning of the General Rationing Provisions Order ;

General Rationing Provisions Order.

the expression " the General Rationing Provisions Order " means the Emergency Powers (General Rationing Provisions) Order, 1944 (S. R. & O. No. 130 of 1944) ;

head of a household.

the expression " head of a household " means a head of a household within the meaning of the General Rationing Provisions Order ;

institution.

the word " institution " includes a hospital, sanatorium, convalescent home, nursing home, school, college, convent, monastery, or any similar institution ;

licensed miller.

the expression " licensed miller " means the holder of a licence granted in respect of a mill under section 21 of the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933) ;

Minister.

the expression " the Minister " means the Minister for Industry and Commerce ;

permit.

the word " permit " means a permit granted under this Order ;

permit voucher the expression " permit voucher " means a voucher which forms or formed part of a permit ;

ration book

the expression " ration book " when used without qualification, means a general ration book, special ration book or ration card ;

ration card.

the expression " ration card " means a food ration card within the meaning of the General Rationing Provisions Order marked with the words " Food Ration Card (Flour or Bread) " ;

ration period

the expression " ration period " means any period declared by a supplemental order to be a ration period for the purposes of this Order ;

ration week.

the expression " ration week " means a period of seven consecutive days commencing on Saturday, the 18th day of January, 1947, or any subsequent Saturday ;

special ration book.

the expression " special ration book " means a special ration book within the meaning of the General Rationing Provisions Order ;

supplemental order.

the expression " supplemental order " means an order made by the Minister and supplemental to this order.

(2) Any reference in this Order to purchasing includes a reference to acquiring otherwise than by purchase and inviting an offer to sell or dispose of otherwise than by sale.

(3) Any reference in this Order to selling includes a reference to disposing of otherwise than by sale, offering or keeping for sale or disposal otherwise than by sale and inviting an offer to purchase or acquire otherwise than by purchase.

4 Domestic consumer

4. For the purposes of this Order, every holder of a ration book shall be a domestic consumer.

5 Registration page

5. For the purposes of this Order—

(a) the registration pages, applicable to a particular ration period, of a general ration book shall be the pages declared by a supplemental order to be the registration pages applicable to that ration period,

(b) the registration pages of a special ration book shall be the pages marked "Flour or Bread".

6 Coupons and validity and exchange value thereof

6. (1) For the purposes of this Order—:

(a) any coupon (other than a coupon marked with the word "Cancelled" or the word "Invalid") which forms part of a general ration book and is declared by a supplemental order to be a flour or bread coupon for the purposes of this Order shall be a flour or bread coupon,

(b) any coupon marked "Flour or Bread" (other than a coupon marked with the word "Cancelled" or the word "Invalid") forming part of a special ration book shall be a flour or bread coupon,

(c) references in this Order to the coupon of a domestic consumer shall be construed as references to a coupon forming part of a ration book of such consumer.

(2) For the purposes of this Order, each flour or bread coupon forming part of a general ration book shall be valid only for the ration week for which it is declared by a supplemental order to be valid.

(3) For the purposes of this Order—

(a) the flour exchange value of a flour or bread coupon during any ration week shall be the quantity of flourdeclared by a supplemental order to be the exchange value of a flour or bread coupon during that ration week,

(b) the bread exchange value of a flour or bread coupon during any ration week shall be the quantity of bread declared by a supplemental order to be the exchange value of a flour or bread coupon during that ration week,

(c) the flour exchange value of a ration card during any ration week shall be the quantity of flour declared by a supplemental order to be the flour exchange value of a ration card during that ration week,

(d) the bread exchange value of a ration card during any ration week shall be the quantity of bread declared by a supplemental order to be the bread exchange value of a ration card during that ration week.

7 Non-application of Order tosample obtained under Sale of Food and Drugs Act, 1875

7. Where a sample of flour or bread is procured at a shop under section 13 of the Sale of Food and Drugs Act, 1875, this Order shall not apply in respect of such flour or bread.

8 Non-application of Order to flour or bread obtained by means of food vouchers.

8. Where flour or bread is obtained in exchange for a food voucher issued under a domiciliary care scheme by a local authority, or issued by a local authority to a person in receipt of home assistance or issued under the Emergency Powers (Food Allowances) Order, 1941 (S. R. & O. No. 412 of 1941), this Order shall not apply in respect of such flour or bread.

9 Method of cancellation of coupon

9. Where a person is required by this Order to cancel a coupon, he shall do so by endorsing, with an indelible pencil or indelible ink, on the coupon the mark " X ".

10 Requirement that bread shall be sold by weight

10. (1) Bread shall be sold by weight.

(2) Paragraph (1) of this Article shall not apply to a sale of bread for consumption on the premises where it is sold.

11 Persons under the age of 16 etc

11. Any act required or authorised by this Order to be done by a person may, in the case of a person under the age of 16 years, be done on his behalf by one of his parents or by his guardian or by the person having custody of him, and, in the case of a person prevented by infirmity of mind or body from doing such act, by a person acting on his behalf or the person in charge of him.

PART II.REGISTRATION AND RATIONING OF DOMESTIC CONSUMERS.

12 Registration of domestic consumer who is holder of general ration book as flour customer of flour retailer

12. Where, before or during the currency of a ration period, a domestic consumer who is the holder of a general ration book applies to a flour retailer to be registered as a flour customer of the retailer and produces the general ration book and either one only or both of the registration pages thereof applicable to the period—

(a) (i) in case either the application is made before the commencement of the period and the applicant is then registered under this Article as a flour customer of the retailer or the applicant, not having previously been registered under this Article as a flour customer of the retailer, has been previously a customer ordinarily purchasing flour from the retailer or a member of the household of or a resident with such a customer—the retailer shall grant the application,

(ii) in any other case—the retailer may grant or refuse the application ;

(b) where the retailer grants the application he shall do the following things :—

(i) if the name and address of the applicant are not already entered in the appropriate place in the registration page or pages, cause them to be entered therein,

(ii) if the word " flour " is not written on the registration page or pages, cause that word to be written thereon,

(iii) retain the registration page or pages,

(iv) enter, on the inside of the cover of the general ration book, if they are not already entered therein, his name and address, the words and figures " page (the number or numbers of the registration page or pages) deposited " and the date of the deposit,

(v) return the general ration book to the applicant,

and thereupon the applicant shall, so long as the registration page or pages is or are retained by the retailer and any coupon attached thereto remains unused, bedeemed, for the purposes of this Order, to be registered as a flour customer of the retailer.

13 Registration of domestic consumer who is holder of special ration book as flour customer of flour retailer

13. Where a domestic consumer who is the holder of a special ration book applies to a flour retailer to be registered as a flour customer of the retailer and produces the special ration book and either one only or both of the registration pages thereof—

(a) (i) in case either the applicant is then registered under this Article as a flour customer of the retailer or the applicant, not having previously been registered under this Article as a flour customer of the retailer, has been previously a customer ordinarily purchasing flour from the retailer or a member of the household of or a resident with such a customer—the flour retailer shall grant the application,

(ii) in any other case—the retailer may grant or refuse the application ;

(b) where the retailer grants the application, he shall do the following things :—

(i) if the name and address of the applicant are not entered in the appropriate place in the registration page or pages, cause them to be entered therein,

(ii) if the word " flour " is not written on the registration page or pages, cause that word to be written thereon,

(iii) retain the registration page or pages,

(iv) enter, on the inside of the cover of the special ration book, if they are not already entered therein, his name and address, the words and figures " page (the number or numbers of the registration page or pages) deposited " and the date of the deposit,

(v) return the special ration book to the applicant,

and thereupon the applicant shall, so long as the registration page or pages is or are retained by the retailer and any coupon attached thereto remains unused, be deemed, for the purposes of this Order, to be registered as a flour customer of the retailer.

14 Registration of domestic consumer who is holder of general ration book as bread customer of bread retailer

14. (1) Where, before or during the currency of a ration period, a domestic consumer who is the holder of a general ration book applies to a bread retailer to be registered as a bread customer of the retailer and produces the general ration book and either one only or both of the registration pages thereof applicable to the period—

(a) (i) in case either the application is made before the commencement of the period and the applicant is then registered under this Article as a bread customer of the retailer or the applicant, not having previously been registered under this Article as a bread customer of the retailer, has been previously a customer ordinarily purchasing bread from the retailer or a member of the household of or a resident with such a customer—the retailer shall grant the application,

(ii) in any other case—the retailer may grant or refuse the application ;

(b) where the retailer grants the application, he shall do the following things :—

(i) if the name and address of the applicant are not already entered in the appropriate place in the registration page or pages, cause them to be entered therein,

(ii) if the word " bread " is not written on the registration page or pages, cause that word to be written thereon,

(iii) retain the registration page or pages,

(iv) enter, on the inside of the cover of the general ration book, if they are not already entered therein, his name and address, the words and figures " page (the number or numbers of the registration page or pages) deposited " and the date of the deposit,

(v) return the general ration book to the applicant,

(vi) give to him a bread ration card in the form set out in the First Schedule to this Order,

and thereupon the applicant shall, so long as the registration page or pages is or are retained by the retailer and any coupon attached thereto remains unused, be deemed,for the purposes of this Order, to be registered as a bread customer of the retailer.

(2) Where two or more persons who are members of a household or are residing in an institution are applicants under this Article to a bread retailer, the bread retailer shall be deemed to have satisfied his obligation under paragraph (I) of this Article to give a bread ration card to each of such persons if he gives to one of them one bread ration card in relation to all of them.

(3) Where a bread retailer gives a bread ration card pursuant to this Article, the following provisions shall have effect during the period to which the card relates ;—

(a) the person to whom the card is given shall retain it and produce it whenever there is purchased, save under a permit voucher, bread from the retailer for any person to whom the card relates,

(b) the retailer shall not sell, save under a permit voucher, bread for any person to whom the card relates unless the card is produced at the time of sale and shall, at the time of any sale, save a sale under a permit voucher, by him of bread for a person to whom the card relates, enter on the card the appropriate particulars indicated therein.

15 Registration of domestic consumer who is holder of special ration book as bread customer of bread retailer

15. (1) Where a domestic consumer who is the holder of a special ration book applies to a bread retailer to be registered as a bread customer of the retailer and produces the special ration book and either one only or both of the registration pages thereof—

(a) (i) in case either the applicant is then registered under this Article as a bread customer of the retailer or the applicant, not having previously been registered under this Article as a bread customer of the retailer, has been previously a customer ordinarily purchasing bread from the retailer or a member of the household of or a resident with such a customer—the retailer shall grant the application,

(ii) in any other case—the retailer may grant or refuse the application ;

(b) where the retailer grants the application, he shall do the following things :—

(i) if the name and address of the applicant are notentered in the appropriate place in the registration page or pages, cause them to be entered therein,

(ii) if the word " bread " is not written on the registration page or pages, cause that word to be written thereon,

(iii) retain the registration page or pages,

(iv) enter, on the inside of the cover of the special ration book, if they are not already entered therein, his name and address, the words and figures " page (the number or numbers of the registration page or pages) deposited " and the date of the deposit,

(v) return the special ration book to the applicant,

(vi) give to him a bread ration card in the form set out in the First Schedule to this Order,

and thereupon the applicant shall, so long as the registration page or pages is or are retained by the retailer and any coupon attached thereto remains unused, be deemed, for the purposes of this Order, to be registered as a bread customer of the retailer.

(2) Where a bread retailer gives a bread ration card to a domestic consumer pursuant to this Article, the following provisions shall have effect during the period to which the card relates :—

(a) the consumer shall retain the card and produce it whenever he purchases, save under a permit voucher, bread from the retailer,

(b) the retailer shall not sell, save under a permit voucher, bread to the consumer unless the card is produced at the time of sale and shall, at the time of any sale, save a sale under a permit voucher, by him of bread to the consumer, enter on the card the appropriate particulars indicated therein.

16 Supplemental provisions relation to registration

16. (1) Where a domestic consumer satisfies the Minister or an authorised officer that he has made reasonable efforts to effect his registration under Article 12 or 13 of this Order but has been unable to do so, the Minister or such officer may require any flour retailer to grant an application duly made by the consumer for registration as a flour customer of the retailer, and the retailer shall grant the application.

(2) Where a domestic consumer satisfies the Minister or an authorised officer that he has made reasonable efforts to effect his registration under Article 14 or 15 of this Order but has been unable to do so, the Minister or such officer may require any bread retailer to grant an application duly made by the consumer for registration as a bread customer of the retailer, and the retailer shall grant the application.

(3) Where a person registered under Article 12 or 13 of this Order as a flour customer of a flour retailer dies, the person having possession of the general ration book or special ration book of the deceased shall, within seven days of the death, notify the retailer of the death and thereupon the retailer shall deliver to him the relevant registration page or pages.

(4) Where a person registered under Article 14 or 15 of this Order as a bread customer of a bread retailer dies, the person having possession of the general ration book or special ration book of the deceased shall, within seven days of the death, notify the retailer of the death and thereupon the retailer shall deliver to him the relevant registration page or pages.

(5) Upon a registration page having been delivered under paragraph (3) or (4) of this Article—

(a) if the death did not result from an infectious or contagious disease, the person to whom the page was delivered shall forthwith send it to the Minister with a notification of the death,

(b) if the death resulted from an infectious or contagious disease, the page shall be disposed of in such manner as the Medical Officer of Health of the area in which the death took place may direct.

(6) Where a person registered under Article 12, 13, 14 or 15 leaves the State he shall take the relevant registration page or pages with him and for that purpose shall withdraw it or them from the person with whom it or they was or were lodged.

(7) Where a person has failed to comply with paragraph (6) of this Article, the head of a household in whose house he resided immediately before leaving the State shall withdraw the relevant. registration page or pages and deliver it or them to the Minister within four weeks after the departure of such person.

(8) Where a person registered under Article 12, 13, 14 or 15 joins the Defence Forces, he shall hand up the relevant registrationpage or pages to the military authorities and for that purpose shall withdraw it or them from the person with whom it or they was or were lodged.

(9) Where a person has failed to comply with paragraph (8) of this Article, the head of a household in whose house he resided immediately before joining the Defence Forces shall withdraw the relevant registration page or pages and deliver it or them to the Minister within four weeks after such person joined the Defence Forces.

(10) Where a registration page of any person is lodged under Article 12, 13, 14 or 15 of this Order with a retailer, the retailer shall, if so requested by such person or the head of a household authorised by this Article to withdraw the page, return the page to such person or head of a household.

(11) A retailer with whom a page of a ration book is lodged under Article 12, 13, 14 or 15 of this Order shall not return the page to the holder of the ration book save under paragraph (10) of this Article or when directed by the Minister or an authorised officer.

(12) An authorised officer may request any person (who shall comply with the request) to state—

(a) whether he is registered under Article 12, 13, 14 or 15 of this Order, and

(b) if he is so registered, the name and address of the retailer with whom he is so registered.

17 Restriction on purchase of flour by domestic consumer and on sale of flour by flour retailer

17. (1) A domestic consumer shall not purchase flour unless—

(a) he is for the time being registered under this Order as a flour customer with a flour retailer and purchases the flour from such retailer, or

(b) he is the holder of a ration card and he surrenders such card at the time when the first purchase of flour by reference to such card is made.

(2) A flour retailer shall not sell flour to a domestic consumer unless—

(a) the consumer is for the time being registered under this Order with the retailer as a flour customer, or

(b) the consumer is the holder of a ration card and he surrenders such card at the time when the first sale of flour by reference to such card is made.

18 Restriction on purchase of bread by domestic consumer and on sale of bread by bread retailer

18. (1) A domestic consumer shall not purchase bread unless—

(a) he is for the time being registered under this Order as a bread customer with a bread retailer and purchases the bread from such retailer, or

(b) he is the holder of a ration card and he surrenders such card at the time when the first purchase of bread by reference to such card is made.

(2) A bread retailer shall not sell bread to a domestic consumer unless—

(a) the consumer is for the time being registered under this Order with the retailer as a bread customer, or

(b) the consumer is the holder of a ration card and he surrenders such card at the time when the first sale of bread by reference to such card is made.

19 Weekly ration of flour of domestic consumer

19. (1) Subject to paragraphs (2) and (3) of this Article, a flour retailer shall not, during any ration week, sell to a domestic consumer, nor shall a domestic consumer purchase from a flour retailer during any ration week, any flour in excess of—

(a) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment either of two registration pages of a general ration book or a special ration book—twice the flour exchange value of a flour or bread coupon,

(b) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment of one registration page only of a general ration book or a special ration book—the flour exchange value of a flour or bread coupon,

(c) in case the consumer is the holder of a ration card—the flour exchange value of a ration card.)

(2) A flour retailer may during a ration week sell to a domestic consumer who is the holder of general ration book and who is registered under this Order as a flour customer with the retailer by the lodgment of two registration pages, and the consumer may purchase during the ration week from the retailer, a quantity of flour not exceeding eight times the flour exchange value of a flour or bread coupon during the ration week, and in such case the following provisions shall have effect :

(a) in case the quantity of flour so sold does not exceed four times the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the next following ration week any flour,

(ii) the flour or bread coupons of the consumer valid for the said next following ration week shall be deemed to be valid for the previous ration week,

(b) in case the quantity of flour so sold exceeds four times, but does not exceed six times, the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the two next following ration weeks any flour,

(ii) the flour or bread coupons of the consumer valid for the said next following ration weeks shall be deemed to be valid for the said previous ration week,

(c) in case the quantity of flour so sold exceeds six times the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the three next following ration weeks any flour,

(ii) the flour or bread coupons of the consumer valid for the said next following ration weeks shall be deemed to be valid for the said previous ration week.

(3) A flour retailer may during a ration week sell to a domestic consumer who is the holder of a general ration book and who is registered under this Order as a flour customer with the retailer by the lodgment of one registration page only, and the consumer may purchase during the ration week from the retailer, a quantity of flour not exceeding four times the flour exchange value of a flour or bread coupon during the ration week, and in such case the following provisions shall have effect :—

(a) in case the quantity of flour so sold does not exceed twice the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the next following ration week any flour,

(ii) the flour or bread coupon of the registration page valid for the said next following ration week shall be deemed to be valid for the previous ration week,

(b) in case the quantity of flour so sold exceeds twice, but does not exceed three times, the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase during the two next following ration weeks any flour,

(ii) the flour or bread coupons of the registration page valid for the said next following ration weeks shall be deemed to be valid for the said previous ration week,

(c) in case the quantity of flour so sold exceeds three times the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the three next following ration weeks any flour,

(ii) the flour or bread coupons of the registration page valid for the said next following ration weeks shall be deemed to be valid for the said previous ration week.

20 Weekly ration of bread of domestic consumer

20. A bread retailer shall not, during any ration week, sell to a domestic consumer, nor shall a domestic consumer purchase from a bread retailer during any ration week, any bread in excess of—

(a) in case the consumer is registered under this Order as a bread consumer with the retailer by the lodgment of two registration pages of a general ration book or a special ration book—twice the bread exchange value of a flour or bread coupon,

(b) in case the consumer is registered under this Order as a bread customer with the retailer by the lodgment of one registration page only of a general ration book or a special ration book—the bread exchange value of a flour or bread coupon,

(c) in case the consumer is the holder of a ration card—the bread exchange value of a ration card.

21 Cancellation of flour or bread coupon of domestic consumer by flour retailer

21. (1) Where a flour retailer sells, otherwise than under a permit voucher, flour to a domestic consumer during a ration week—

(a) if the consumer is the holder of a general ration book, the retailer shall at the end of that ration week cancel—

(i) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment of two registration pages—the flour or bread coupons of the consumer valid for the ration week and, if the retailer has during the ration week supplied any flour to the consumer under paragraph (2) of Article 19 of this Order, every flour or bread coupon of the consumer deemed by that paragraph to be valid for the ration week,

(ii) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment of one registration page only—the flour or bread coupon of the registration page valid for the ration week and, if the retailer has during the ration week supplied any flour to the consumer under paragraph (3) of Article 19 of this Order, every flour or bread coupon of the registration page deemed by that paragraph to be valid for the ration week,

(b) if the consumer is the holder of a special ration book, the retailer shall at the end of the ration week cancel

(i) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment of two registration pages—two flour or bread coupons of the consumer,

(ii) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment of one registration page only—one flour or bread coupon of the consumer.

(2) Where a coupon is cancelled under subparagraph (a) or (b) of paragraph (1) of this Article, the flour retailer cancelling it shall not, unless so directed by the Minister, detach such coupon from the registration page of the ration book of which it formspart and, if so directed, shall dispose of the detached coupon in accordance with the directions of the Minister.

22 Cancellation of flour or bread coupon of domestic consumer by bread retailer

22. (1) Where a bread retailer sells, otherwise than under a permit voucher, bread to a domestic consumer during a ration week—

(a) if the consumer is the holder of a general ration book, the retailer shall at the end of the ration week cancel—

(i) in case the consumer is registered under this Order as a bread customer with the retailer by the lodgment of two registration pages—the flour or bread coupons of the consumer valid for the ration week,

(ii) in case the consumer is registered under this Order as a bread customer with the retailer by the lodgment of one registration page only—the flour or bread coupon of the registration page valid for the ration week,

(b) if the consumer is the holder of a special ration book, the retailer shall at the end of the ration week cancel—

(i) in case the consumer is registered under this Order as a bread customer with the retailer by the lodgment of two registration pages—two flour or bread coupons of the consumer,

(ii) in case the consumer is registered under this Order as a bread customer with the retailer by the lodgment of one registration page only—one flour or bread coupon of the consumer.

(2) Where a coupon is cancelled under sub-paragraph (a) or (b) of paragraph (1) of this Article, the bread retailer cancelling it shall not, unless so directed by the Minister, detach such coupon from the registration page of the ration book of which it forms part and, if so directed, shall dispose of the detached coupon in accordance with the directions of the Minister.

PART III.PURCHASE OF FLOUR AND BREAD BY TRADERS.

23 Purchase by flour retailer of flour from flour wholesaler or licensed miller

23. (1) A flour retailer may purchase from a flour wholesaler or a licensed miller, and the flour wholesaler or licensed miller may sell to the flour retailer, flour for sale by retail if the flour retailer completes a certificate in the form set out in the Second Schedule to this Order, sends such certificate to the flour wholesaleror licensed miller and a copy thereof to the Minister and complies with the instructions in such certificate.

(2) When a flour retailer surrenders during any ration week for flour for sale by retail a ration card to a flour wholesaler or a licensed miller, the flour retailer may purchase from the flour wholesaler or licensed miller, and the flour wholesaler or licensed miller may sell to the flour retailer, for sale by retail the flour exchange value of the ration card during that week.

(3) A flour retailer shall not purchase from a flour wholesaler or a licensed miller, nor shall a flour wholesaler or a licensed miller sell to a flour retailer, flour for sale by retail save in conformity with this Article.

24 Purchase by flour wholesaler of flour from licensed miller or another flour wholesaler

24. (1) A flour wholesaler may purchase from a licensed miller or another flour wholesaler, and the licensed miller or other flour wholesaler may sell to the flour wholesaler, flour for sale by wholesale if the flour wholesaler completes a certificate in the form set out in the Third Schedule to this Order, sends such certificate to the licensed miller or other flour wholesaler and a copy thereof to the Minister and complies with the instructions in such certificate.

(2) Where a flour wholesaler surrenders during any ration week for flour for sale by wholesale a ration card to a licensed miller or another flour wholesaler, the flour wholesaler may purchase from the licensed miller or other flour wholesaler, and the licensed miller or other flour wholesaler may sell to the flour wholesaler, for sale by wholesale the flour exchange value of the ration card during that week.

(3) A flour wholesaler shall not purchase from a licensed miller or another flour wholesaler, nor shall a licensed miller sell to a flour wholesaler or a flour wholesaler sell to another flour wholesaler, flour for sale by wholesale save in conformity with this Article.

25 Purchase by baker of flour from licensed miller or flour wholesaler

25. (1) A baker may purchase from a licensed miller or flour wholesaler, and the licensed miller or flour wholesaler may sell to the baker, flour for baking bread if the baker completes a certificate in the form set out in the Fourth Schedule to this Order, sends such certificate to the licensed miller or flour wholesalerand a copy thereof to the Minister and complies with the instructions in such certificate.

(2) Where a baker surrenders during any ration week for flour for baking bread a ration card to a licensed miller or flour wholesaler, the baker may purchase from the licensed miller or flour wholesaler, and the licensed miller or flour wholesaler may sell to the baker, for baking bread the flour exchange value of the ration card during that week.

(3) A baker shall not purchase from a licensed miller or flour wholesaler, nor shall a licensed miller or flour wholesaler sell to a baker, flour for baking bread save in conformity with this Article.

26 Purchase by bread retailer of bread from bread wholesaler or baker

26. (1) A bread retailer may purchase from a bread wholesaler or a baker, and the bread wholesaler or baker may sell to the bread retailer, bread for sale by retail if the bread retailer completes a certificate in the form set out in the Fifth Schedule to this Order, sends such certificate to the bread wholesaler or baker and a copy thereof to the Minister and complies with the instructions in such certificate.

(2) Where a bread retailer surrenders during any ration week for bread for sale by retail a ration card to a bread wholesaler or a baker, the bread retailer may purchase from the bread wholesaler or baker, and the bread wholesaler or baker may sell to the bread retailer, for sale by retail the bread exchange value of the ration card during that week.

(3) A bread retailer shall not purchase from a bread wholesaler or a baker, nor shall a bread wholesaler or a baker sell to a bread retailer, bread for sale by retail save in conformity with this Article.

27 Purchase by bread wholesaler of bread from baker

27. (1) A bread wholesaler may purchase from a baker, and the baker may sell to the bread wholesaler, bread for sale by wholesale if the bread wholesaler completes a certificate in the form set out in the Sixth Schedule to this Order, sends such certificate to the baker and a copy thereof to the Minister and complies with the instructions in such certificate.

(2) Where a bread wholesaler surrenders during any ration week for bread for sale by wholesale a ration card to a baker, the bread wholesaler may purchase from the baker, and the baker may sell to the bread wholesaler, for sale by wholesale the bread exchange value of the ration card during that week.

(3) A bread wholesaler shall not purchase from a baker, nor shall a baker sell to a bread wholesaler, bread for sale by wholesale save in conformity with this Article.

PART IV.PERMITS AND PERMIT VOUCHERS.

28 Grant of permits and permit vouchers

28. (1) The Minister may, in his absolute discretion, grant permits to which are attached vouchers authorising the purchase of flour or bread.

(2) Notwithstanding paragraph (1) of this Article, the Minister shall not—

(a) grant a permit to the proprietor of a catering establishment for the purchase of flour or bread for the purposes of the establishment unless the establishment is registered in the Register of Catering Establishments kept under the Emergency Powers (Rationing) (Registration of Catering Establishments and Institutions) Order, 1942 (S. R. & O. No. 291 of 1942),

(b) grant a permit to the head of an institution for the purchase of flour or bread for the purposes of the institution unless the institution is registered in the Register of Institutions kept under the Emergency Powers (Rationing) (Registration of Catering Establishments and Institutions) Order, 1942 (S. R. & O. No. 291 of 1942).

29 Use of permit vouchers

29. Notwithstanding anything contained in this Order—

(a) where the holder of a permit lodges a permit voucher attached to the permit with a supplier of bread or flour, he may purchase from the supplier, and the supplier may sell to him, bread or flour in accordance with the terms of the permit voucher,

(b) where a permit voucher has been lodged with a supplier of flour or bread and he lodges the permit voucher with another supplier of flour or bread, he may purchase from the other supplier, and the other suppliermay sell to him, bread or flour in accordance with the terms of the permit voucher.

PART V.MISCELLANEOUS.

30 Prohibition of borrowing or lending flour or bread

30. A person shall not borrow or lend bread or flour.

31 Restrictions on certain traders

31. (1) A flour retailer, flour wholesaler, licensed miller or baker shall not during any ration week convert to his own use—

(a) in case he converts during the ration week any bread to his own use, any flour in excess of the flour exchange value of a flour or bread coupon,

(b) in case he does not convert during the ration week any bread to his own use, any flour in excess of twice the flour exchange value of a flour or bread coupon.

(2) A bread retailer, bread wholesaler or baker shall not during any week convert to his own use—

(a) in case he converts during the ration week any flour to his own use, any bread in excess of the bread exchange value of a flour or bread coupon,

(b) in case he does not convert during the ration week any flour to his own use, any bread in excess of twice the bread exchange value of a flour or bread coupon.

32 Prohibition of certain lotteries

32. (1) A person shall not promote a lottery to which this Article applies.

(2) A person shall not sell or distribute or offer for sale or distribution, or cause any other person to sell or distribute, any ticket or chance in a lottery to which this Article applies.

(3) This Article applies to any lottery the prizes in which consist (wholly or partly) of flour or broad.

33 Prohibition on false information in certificate

33. A person shall not, in any certificate sent by him pursuant to this Order, give any information which to his knowledge is false or misleading.

34 Records to be kept by flour retailer or bread retailer

34. A flour retailer or bread retailer shall keep records of his stocks, purchases and sales of flour and bread in the form set out in the Seventh Schedule to this Order.

35 Records to be kept by flour wholesaler, bread wholesaler, baker or licensed miller

35. A flour wholesaler, bread wholesaler, baker or licensed miller shall keep records showing every purchase or sale of bread or flour effected by him.

36 Production of books, etc

36. A person who carries on the business of selling flour or bread by retail or wholesale, baking bread or milling flour, or is employed in any such business, is hereby required, from time to time—

(a) to produce, at the request of an authorised officer, to such officer any books, documents or records relating to the business which are in the power, possession or procurement of such person, to permit such officer to inspect and take extracts from such books, documents or records and to give to such officer any information, which he may reasonably require, in regard to any entries in such books, documents or records,

(b) to afford to an authorised officer all reasonable facilities for the examination, inspection and taking stock of any flour or bread carried in connection with the business,

(c) to give to an authorised officer any information, which he may reasonably require, in regard to the manufacture, sale, purchase or storage of flour or bread for the purposes of the business.

(5) This Form is to be used to obtain supplies for your Bakery only. If you are also a retailer of flour, you must use Form F.B.R. 1 to get supplies for your retail trade. If you are also a wholesaler of flour, you must use Form F.B.R. 2 to get supplies for your wholesale trade.
