WEIGHTS AND MEASURES (VERIFICATION AND STAMPING OF BOTTLES) (FEES) REGULATIONS, 1946.

The Minister for Industry and Commerce, in exercise of the powers conferred on him by section 8 of the Weights and Measures Act, 1928 (No. 3 of 1928), and of every and any other power him in this behalf enabling and with the consent of the Minister for Finance, hereby makes the following Regulations :—

1. These Regulations may be cited as the Weights and Measures (Verification and Stamping of Bottles) (Fees) Regulations, 1946.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. These Regulations shall come into operation on the 1st day of September, 1946.

4. In these Regulations, the expression " the Minister " means the Minister for Industry and Commerce.

5. The following provisions shall have effect in relation to the fees to be paid in respect of the verification and stamping of bottles under a licence granted under section 7 of the Weights and Measures Act, 1928 , authorising the stamping of bottles during the process of manufacture, that is to say :—

(a) the fees shall be calculated by reference to the monthly output of bottles from the factory and at the rate of 1s. 1d. per gross of such output,

(b) the fees in respect of the output of bottles from the factory during each month shall be paid on or before the 10th day of the following month,

(c) irrespective of the output of the factory, an additional fee of 6d. per gross of the bottles shall be payable where the Minister is not satisfied that the proprietor of the factory has provided accommodation, equipment, requisites, and assistance in accordance with the requirements of paragraph (c) of regulation 11 of the Weights and Measures (Bottle Factory) Regulations, 1928 (S. R. & O., No. 73 of 1928).

6. Where an ex-officio inspector of weights and measures who has been duly appointed for the purpose as a special inspector under the provisions of the Weights and Measures Act, 1928 , verifies and stamps bottles to which that Act applies, not being less than twenty gross in number, on the premises of the owner of the bottles and all necessary and reasonable accommodation and manual assistance required by the special inspector are provided by the said owner, the fees payable for the verification and stamping of the bottles shall be calculated at the rate of 4s. 0d. per gross of the bottles.

7. In a case to which neither Article 5 nor 6 of these Regulations applies, the fees to be paid for the verification and stamping of bottles to which the Weights and Measures Act, 1928 , applies shall be calculated at the rate of one half-penny per bottle.

8. The Weights and Measures (Verification and Stamping of Bottles) (Fees) Regulations, 1942 (S. R. & O., No. 82 of 1942), are hereby revoked.
