CHILDREN'S ALLOWANCES (QUALIFYING DATES) (No. 2) REGULATIONS, 1946.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by the Children's Allowances Acts, 1944 and 1946, hereby make the following regulations :

1. These Regulations may be cited as the Children's Allowances (Qualifying Dates) (No. 2) Regulations, 1946.

2. (1) Where, in relation to a particular qualifying date, a person has been awarded a children's allowance for a payment period, the first day of the third last month within which that period is due to fall is hereby appointed as the next qualifying date for that person, if on that day he is still entitled to the said allowance.

(2) The First Schedule to these regulations is inserted solely for the purpose of illustrating the application of paragraph (1) of this Article and nothing therein shall be construed as affecting in any way the application of the said paragraph (1).

3. The dates specified in the Second Schedule to these regulations are hereby appointed as qualifying dates for persons to whom paragraph (1) of Article 2 of these regulations does not apply.

This Schedule covers the great majority of cases of repeat claimants, namely those who, on a date specified as a qualifying date, are resident in the area mentioned opposite to that date and who have been continuously resident in that area since the previous qualifying date.

In all other cases, the next qualifying date can be ascertained under Article 2 (1) of the regulations.
