NATIONAL HEALTH INSURANCE (MARRIAGE BENEFIT) REGULATIONS, 1946.

The Minister for Local Government and Public Health, in exercise of the powers conferred on him by the National Health Insurance Acts, 1911 to 1942, and of every and any other power him in this behalf enabling, by this, his Order, makes the following Regulations :—

1. These Regulations may be cited as the National Health Insurance (Marriage Benefit) Regulations, 1946.

2. In these Regulations, unless the context otherwise requires—

the expression " contribution year " means any period commencing on the 27th Monday in any year and terminating on the day preceding the 27th Monday in the next year ;

the expression " the Schedule " means the Schedule to these Regulations ;

the expression " duration of insurance " means the period from the date of last entry into insurance before marriage up to the date of marriage.

3. The amount of marriage benefit payable under Section 15 of the National Health Insurance Act, 1929 (No. 42 of 1929), shall, subject to the provisions of the next following Regulation, be the sum shown in Part I or Part II of the Schedule, as the case may be, as appropriate to the duration of insurance and the number of contributions paid.

4.—(1) Where the number of contributions credited to a woman in respect of the last complete contribution year before the date of her marriage is 47 or less, the amount of marriage benefit which would otherwise be payable to her in accordance with the provisions of the next preceding Regulation shall be reduced by the amount appearing in column (2) of Part III of the Schedule opposite to the group of numbers in column (1) which comprises the number of contributions credited in the said complete contribution year :

Provided that, in the case of a woman who marries in the period between the 8th day of July, 1946, and the 6th day of July, 1947, the period from the 2nd day of July, 1945, to the 7th day of July, 1946, shall be deemed to be the complete contribution year before the date of marriage.

(2) In calculating for the purposes of this Regulation the number of contributions credited during the last complete contribution year before the date of marriage, the calculation shall be made in accordance with Regulation 4 of the National Health Insurance (Arrears) Regulations, 1946 (S.R. and O., No. 223 of 1946) :

Provided that, in the case of a woman becoming an insured person after the commencement of the said contribution year, contributions shall be deemed to have been paid in respect of the period between the commencement of the said contribution year and the end of the week immediately preceding the date of last entry into insurance before marriage.

5.—(1) These Regulations shall come into operation and have effect as on and from the 8th day of July, 1946.

(2) The National Health Insurance (Marriage Benefit) Regulations 1930 (S.R. and O. No. 36 of 1930), are hereby revoked with effect as on and from the 8th day of July, 1946, but without prejudice to any right or privilege acquired or accrued, or any penalty, obligation or liability incurred, under them prior to that date.
