LAND REGISTRATION RULES, 1946.

The Registration of Title Rules Committee, in exercise of its power in Section 94 (1) of the Registration of Title Act, 1891, as amended by Section 73 of the Courts of Justice Act, 1936 , and of every other power in this behalf, with the concurrence of the Minister for Justice, hereby makes the Rules annexed hereto as General Rules, supplemental to the Land Registration Rules, 1937 and 1944, for carrying into effect the object of the Registration of Title Acts, 1891 and 1942.

Preliminary.

1 Date of Rules

1. These Rules shall come into operation on the 1st day of March, 1946.

2 Interpretation

2. These Rules and the Land Registration Rules, 1937, and the Land Registration Rules, 1944, shall be construed together, and the provisions of Rule 2 (1) and (2) of the Land Registration Rules, 1937, shall apply for the purpose of the interpretation of these Rules.

3. In these Rules "the 1937 Rules" means the Land Registration Rules, 1937, and "the 1944 Rules" means the Land Registration Rules, 1944.

Amendments of Land Registration Rules, 1937 and 1944.

4 Rescision of Rule 34 of the 1937 Rules, and Rule 20 of the 1944 Rules

4.(a) Rule 34 of the 1937 Rules and Rule 20 of the 1944 Rules, (amending said Rule 34) are hereby rescinded.

(b) Form 11 in the Schedule of Forms annexed to the 1937 Rules is hereby deleted.

(c) The reference to Rule 34 in Part II of the Schedule of Costs annexed to the 1937 Rules is hereby deleted.

5 Amendment of Rules 242 (iii) and 244 (ii) and (iii) of the 1937 Rules

5. Rules 242 and 244 of the 1937 Rules are hereby amended as follows :—

(a) by deleting the figures "34" on line 3 of sub-clause (iii) of said Rule 242 (1).

(b) by deleting the figures "34" on line 4 of sub-clause (ii) of Rule 244 (1).

(c) by deleting the figures "34 or" on line 5 of sub-clause (iii) of Rule 244 (1).

6 Amendment of Rule 3 (1) of the 1944 Rules

6. Clause (1) of Rule 3 of the 1944 Rules is hereby amended so as to read as follows :—

(1) An Application for registration pursuant to an Order of the Court under Section 21 of the Registration of Title Act, 1942 , by a person claiming to be registered as owner of freehold registered land to which Part IV of the Act of 1891 applies, in succession to a deceased full owner of such land, shall be made in Form 17 in the Schedule of Forms annexed to the 1937 Rules.

Form 1 in the Schedule of Forms annexed to the 1944 Rules is hereby deleted.
