LOCAL GOVERNMENT (MINOR OFFICERS) ORDER, 1943.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

The Minister for Local Government and Public Health in exercise of the powers conferred on him by sub-section (I) of section 8, section 9 and section 11 and paragraph (a) of subsection (I) of section 19 of the Local Government Act, 1941 , and in exercise of all other powers in this behalf enabling him hereby orders as follows :—

1. This Order may be cited as the Local Government (Minor Officers) Order, 1943.

2. In this Order—

the expression " the Act " means the Local Government Act, 1941 ;

the expression " scheduled office " means the office of any of the officers mentioned in the schedule to this Order ; and the expression "scheduled officer" shall be construed accordingly ;

the word " substitute " means a person appointed to act as a substitute for the holder of an office while the office is vacant pending a permanent appointment, or while such holder is on vacation or is through illness, absence or suspension temporarily unable to perform his duties.

3. No scheduled office shall be a major office ; and the provisions of the Local Offices and Employments Order, 1924, which were continued in force by sub-section (3) of section 9 of the Act shall be amended accordingly.

4. Unless and until the Minister shall otherwise direct or approve the remuneration of the holder of a scheduled office which is in existence at the date of this Order and the duties of which have not been substantially reduced after the said date shall be the same as the remuneration of the holder of such office on the said date or, if such office is vacant on such date, of the last holder of such office.

5. Unless and until the Minister shall otherwise direct or approve, the remuneration of any person appointed temporarily to a scheduled office as a substitute shall if any person has previously been appointed to such office at a remuneration which has been consented to unconditionally by the Minister, be the remuneration so consented to.

6.—(1) Subject to the provisions of sub-article (2) of this Article and unless and until the Minister shall otherwise direct or approve every local authority shall appoint scheduled officers of such a kind and number as shall be necessary to fill every scheduled office under such authority which is, with the approval or in pursuance of a direction of the Minister, in existence at the date of this Order and no other scheduled officers.

(2) The provisions of sub-article (1) of this Article shall not apply so as to prevent the appointment of officers under and in accordance with sub-articles (6) and (7) of Article 43 of the Public Assistance (General Regulations) Order, 1942.
