STATUTORY RULES AND ORDERS. 1943. No. 43.

HARBOUR RATES (SLIGO PORT AND HARBOUR) ORDER, 1943.

WHEREAS it is enacted by subsection (1) of section 3 of the Harbours (Regulation of Rates) Act, 1934 (No. 2 of 1934), that the Minister for Industry and Commerce may, if and whenever he thinks fit on the application of the harbour authority for any harbour, by order (in the said Act referred to as a harbour rates order) fix all or any of the rates, or, where he so thinks fit, the maximum rates to be charged by the harbour authority of such harbour, and may for that purpose revoke, modify, alter or extend by such order any statutory or other provision fixing, restricting, or otherwise regulating the rates or the maximum or minimum rates chargeable by such harbour authority :

AND WHEREAS the Sligo Harbour Commissioners have applied pursuant to section 4 of the said Act to the Minister for Industry and Commerce for a harbour rates order in respect of the Port and Harbour of Sligo fixing certain rates to be charged by the said Commissioners :

AND WHEREAS the Minister for Industry and Commerce has pursuant to the provisions of subsection (1) of section 5 of the said Act given notice dated the 7th day of January, 1943, of his proposal to make such order to the said Commissioners, and has given the directions mentioned in that subsection in respect of the notice required thereby to be published by the said Commissioners :

AND WHEREAS the said Commissioners have duly published such notice, and such notice has contained the directions mentioned in subsection (2) of section 5 of the said Act as regards making objections and representations to the Minister for Industry and Commerce in respect of such proposed order :

NOW, THEREFORE, I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection (1) of section 3 of the Harbours (Regulation of Rates), Act, 1934 (No. 2 of 1934), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say :—

1 Short title and commencement.

1. (1) This Order may be cited as the Harbour Rates (Sligo Harbour) Order, 1943.

(2) This Order shall come into operation on the 22nd day of February, 1943.

2 Application of Interpretation Act, 1937 .

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3 Interpretation.

3. (1) In this Order—

the expression " the Act of 1877 " means the Sligo Harbour Act. 1877 ;

the expression " the Order of 1891 " means the Sligo Harbour Order, 1891 ;

the expression " the Order of 1903 " means the Sligo Harbour Order, 1903 ;

the expression " the Order of 1921 " means the Sligo Port and Harbour (Temporary Increase of Charges) Order, 1921 ;

the expression " the Commissioners " means the Sligo Harbour Commissioners ;

the expression " the Port " means the existing Port and Harbour of Sligo ;

the expression " the harbour master " includes any harbour master and deputy or assistant harbour master for the time being appointed by the Commissioners ;

the word " vessel " means a ship, boat or other vessel of any description ;

the expression " the owner", when used in relation to any vessel, shall extend to and include the owner or charterer of the vessel or his agent or consignee ;

the expression " the master ", when used in relation to any vessel, means the person having the command or charge of the vessel for the time being ;

the expression " Great Britain " includes the Channel Islands and the Isle of Man.

(2) This Order shall be construed as one with the Act of 1877, the Order of 1891, and the Order of 1903.

4 New tonnage rates.

4. (1) The Commissioners may demand and take, in respect of all vessels entering or using the Port, rates (in this Order referred to as the new tonnage rates) not exceeding those specified in part I of the First Schedule to this Order.

(2) The provisions set out in Part II of the First Schedule to this Order shall apply in respect of the new tonnage rates.

(3) The new tonnage rates in respect of a vessel shall be paid by the owner or master of the vessel.

(4) The harbour master is authorised and required to refuse to allow any vessel to leave the Port until he receives from the collector of the Commissioners a permit showing that all the new tonnage rates due in respect of such vessel have been paid.

(5) The several statutory provisions and powers in respect of rates, charges, tolls, dues, rents and other money and receipts which may be taken or recovered by way of income by the Commissioners shall respectively extend and apply to the new tonnage rates.

(6) All moneys received by the Commissioners from the new tonnage rates shall be applied by them in the same manner and to the same purposes as the harbour duties receivable under section 68 of the Act of 1877 were applicable.

5 Amendment of section 102 of the Act of 1877 and section 16 of the Order of 1903.

5. Section 102 (which relates to rates on goods shipped or unshipped) of the Act of 1877 and section 16 (which provides for the reckoning of fractional units of one penny as one penny in certain cases) of the Order of 1903 shall be construed and have effect as if for the reference therein to the Third Schedule to the Act of 1877 there were substituted a reference to the Second Schedule to this Order.

6 Amendment of section 22 of the Order of 1903.

6. Section 22 (which relates to harbour light dues) of the Order of 1903 shall be construed and have effect as if for the reference therein to one farthing there were substituted a reference to one penny.

7 Charges for use of planks.

7. The Commissioners may charge for each shipping plank provided by them four shillings.

8 Charge for depositing coal on quays.

8. The Commissioners may charge persons depositing coal on any quay belonging to the Commissioners, a sum calculated at the rate of sixpence per ton.

9 Charge for storage of goods in transit sheds.

9. The Commissioners may charge on any goods remaining in any transit sheds belonging to the Commissioners over fourteen days from the date of the final discharge of such goods—

(a) in case goods remain in the said transit sheds for any period (including the said fourteen days) not exceeding six months, a sum calculated at the rate of eightpence per ton,

(b) in case the goods remain in the said transit sheds for any period (including the said fourteen days) exceeding six months, a sum calculated at the rate of one shilling per ton.

10 Saving.

10. Nothing in this Order contained shall prejudice or affect the powers of the Commissioners to levy, collect or recover any rates, dues or sum, of money leviable by or due to the Commissioners at the commencement of this Order, and such rates, dues, and sums of money may be levied, collected and recovered by the Commissioners in the same manner and subject to the same conditions as if this Order had not been made and come into operation.

11 Revocation of portions of the Act of 1877 of the Order of 1891, and the Order of 1921.

11. The following enactments are hereby revoked, that is to say—

(a) section 68 of, and the Third Schedule to, the Act of 1877,

(b) sections 4 and 5 of, and the Schedule to, the Order of 1891,

(c) section 17 and sections 18, 19, 20 and 21 (in so far as they relate to steam vessels other than steam tugs) of the Order of 1903,

(d) the Order of 1921, except in so far as it relates to charges for the sue of mooring buoys.

FIRST SCHEDULE.

PART I.

Maximum tonnage rates chargeable on all vessels entering or using the Port and Harbour of Sligo.

PART II.

1. The rates mentioned in Part I of this Schedule shall not be chargeable on any boat, smack, cot, gabbard, lighter or wherry which shall not have been registered under the Merchant Shipping Acts and which shall be usually employed in the Port or any part thereof.

2. For the purpose of calculating the rates mentioned in Part I of this Schedule, the rateable tonnage of a vessel shall be taken to be the register tonnage or fifty per cent. of the gross tonnage whichever is the greater.
