STATUTORY RULES AND ORDERS. 1942. No. 338.

OFFENCES AGAINST THE STATE ACT, 1939 (MILITARY CUSTODY) (AMENDMENT) (No. 5) REGULATIONS, 1942.

I, OSCAR TRAYNOR, Minister for Defence, in exercise of the powers conferred on me by subsection (4) of section 50 of the Offences Against the State Act, 1939 (No. 13 of 1939), do hereby make the following regulations, that is to say :—

1. These Regulations may be cited as the Offences Against the State Act, 1939 (Military Custody) (Amendment) (No. 5) Regulations, 1942.

2. These Regulations shall be included amongst the Regulations which may be cited together as the Offence Against the State Act, 1939 (Military Custody) Regulations, 1939 to 1942.

3. In these Regulations—

the expression " the Principal Regulations " means the Offences Against the State Act, 1939 (Military Custody) Regulations, 1939 ( S. R. & O. No. 288 of 1939 ) ;

the expression " the No. 2 Amendment Regulations " means the Offences Against the State Act, 1939 (Military Custody) (Amendment) (No. 2) Regulations, 1940 ( S. R. & O. No. 178 of 1940 ).

4. The Principal Regulations are hereby amended in the following respects and shall be construed and have effect accordingly, that is to say :—

(a) by the insertion before Appendix I of the following—

" Rules for Prisons detailed under " C " of Appendix I.

69.—The Emergency Powers (No. 20) Order, 1940, Detention (No. 2) Directions, 1940 (S. R. & O. No. 102 of 1940), as amended from time to time, shall apply to and govern the conditions of imprisonment of prisoners detained in prisons detailed under " C " of Appendix I, subject to the modification that references in the said Directions to the Commandant and to an internee shall be construed as references to the Governor and to a prisoner respectively." ;

(b) by the deletion at " A " to Appendix I of the words " Curragh No. 1 Internment Camp, Curragh Camp, County Kildare " (which said words were inserted by the No. 2 Amendment Regulations) ;

(c) by the insertion at the end of Appendix I of the following—

" C. Curragh No. 1 Internment Camp, Curragh Camp, County Kildare."

5. The No. 2 Amendment Regulations are hereby revoked.
