DUBLIN DISTRICT MILK BOARD REGULATIONS, 1941.

I, SÉAMAS Ó RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Milk (Regulation of Supply and Price) Acts, 1936 and 1941, and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say :—

1. These Regulations may be cited as the Dublin District Milk Board Regulations, 1941.

2. In these Regulations—

the expression " the Act " means the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), as amended by the Milk (Regulation of Supply and Price) (Amendment) Act, 1941 (No. 11 of 1941) ;

the expression " the Board " means the Dublin District Milk Board ;

the expressions " the register of producers," " the register of retailers " and " the register of wholesalers," mean respectively the register of producers, the register of retailers and the register of wholesalers kept by the Board ;

the expressions " registered producer," " registered retailer " and " registered wholesaler," mean respectively a person registered in the register of producers, the register of retailers and the register of wholesalers ;

the expression " the appointed day " means the 1st day of January, 1942.

3.—(1) Every application under sub-section (1) of section 31 of the act for registration in the register of producers which is made, on or after the appointed day, by a person to whom paragraph (a) of the said sub-section applies shall be in the Form D.B.1 set forth in the Schedule hereto, and shall contain the particulars asked for or otherwise indicated in the said Form.

(2) Every application made, on or after the appointed day, under sub-section (2) of section 31 of the act for registration in the register of retailers shall be in the Form D.B.2 set forth in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that Form.

(3) Every application made, on or after the appointed day, under sub-section (3) of section 31 of the act for registration in the register of wholesalers shall be in the Form D.B.3 set forth in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that Form.

4.—(1) On and after the appointed day the records to be kept under sub-section (1) of section 35 of the act by every person who is registered in respect of any premises in the register of producers and is not registered in the register of retailers in respect of those premises or of premises adjoining such first-mentioned premises shall be in the Form D.B.4 set forth in the Schedule hereto, and the entries to be made in the said records shall be the particulars indicated in the said Form and such entries shall be made on, in the case of milk produced, the date of production or, in the case of milk sold, the date of sale.

(2) On and after the appointed day the records to be kept under sub-section (1) of section 35 of the act by every person who is registered in respect of any premises in the register of producers and is registered in the register of retailers in respect of those premises or of premises adjoining such first-mentioned premises shall be in the Form D.B.5 set forth in the Schedule hereto and the entries to be made in the said records shall be the particulars indicated in the said Form and such entries shall be made on, in the case of milk produced, the date of production or, in the case of milk acquired, the date of acquisition or, in the case of milk sold, the date of sale.

(3) On and after the appointed day, the records to be kept under sub-section (1) of section 35 of the act by every person who is registered in respect of any premises in the register of retailers but is not registered in the register of producers in respect of those premises or of premises adjoining such first-mentioned premises shall be in the Form D.B.6 set forth in the Schedule hereto and the entries to be made in the said records shall be the particulars indicated in the said Form and such entries shall be made on, in the case of milk acquired, the date of acquisition.

(4) On and after the appointed day the records to be kept under sub-section (1) of section 35 of the act by every person who is registered in respect of any premises in the register of wholesalers shall be in the Form D.B.7 set forth in the Schedule hereto and the entries to be made in the said records shall be the particulars indicated in the said Form, and such entries shall be made on, in the case of milk acquired, the date of acquisition.

5.—(1) The return to be sent under sub-section (1) of section 41 of the act to the Board by each registered producer, in respect of any accounting period commencing on or after the appointed day, shall be in the Form D.B.11 set forth in Schedule hereto and shall contain the particulars and details required by the said Form.

(2) The return to be sent under sub-section (2) of section 41 of the act to the Board by each registered retailer, in respect of any accounting period commencing on or after the appointed day, shall be in the Form D.B.12 set forth in Schedule hereto and shall contain the particulars and details required by the said Form.

(3) The return to be sent under sub-section (2) of section 41 of the act to the Board by each registered wholesaler, in respect of any accounting period commencing on or after the appointed day, shall be in the Form D.B.13 set forth in the Schedule hereto and shall contain the particulars and details required by the said Form.

6.—(1) Article 4 of the Dublin District Milk Board (Registration and Records) Regulations, 1936 ( S. R. & O. No. 294 of 1936 ), is hereby revoked as on and from the appointed day.

(2) Article 5 of the Dublin District Milk Board (Registration and Records) Regulations, 1936, shall, as on and from the appointed day, cease to apply in respect of records to be kept under section 35 of the act.

(3) Article 3 of the Dublin District Milk Board (Levy) Regulations, 1936 ( S. R. & O. No. 317 of 1936 ), shall cease to apply in respect of returns under section 41 of the act in relation to any accounting period commencing on or after the appointed day.
