WILD BIRDS (COUNTY WICKLOW) ORDER, 1941.

WHEREAS it is enacted by sub-section (1) of section 7 of the Wild Birds (Protection) Act, 1930, (No. 16 of 1930), that the Minister for Justice may, by order made on the application of the council of a county or county borough, prohibit, for reasons stated in such application, the taking or destroying either generally or in any particular years or year in such county or county borough or any particular parts or part thereof, of the eggs of any wild bird whatsoever or any particular kinds or kind of wild bird :

AND WHEREAS the Council of the County of Wicklow has applied to the Minister for Justice, because of the ever increasing rarity in the said County of the birds concerned, to make an Order prohibiting in each of the years 1942, 1943, 1944, 1945 and 1946 in the County of Wicklow the taking or destroying of the eggs of any of the following kinds of wild bird, that is to say :—

peregrine falcon, merlin, eagles (all species), owls (all species), ring ousel, redstart, blackcap, dipper, crossbill, siskin, goldfinch, woodlark, chough, raven, kingfisher, turtle dove, stock dove, sandpiper, terns (all species), black guillemot, swan :

NOW, I, GERALD BOLAND, Minister for Justice, in exercise of the powers conferred on me by section 7 of the Wild Birds Protection Act, 1930 (No. 16 of 1930), and of every and any other power me in this behalf enabling do hereby, because of the ever increasing rarity of the birds concerned, order as follows :—

1. This Order may be cited as the Wild Birds (County Wicklow) Order, 1941.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. No person shall in any part of the County of Wicklow take or destroy in any of the years 1942, 1943, 1944, 1945 or 1946, the eggs of any of the following kinds of wild bird, that is to say :—

peregrine falcon, merlin, eagles (all species), owls, (all species), ring ousel, redstart, blackcap, dipper, crossbill, siskin, goldfinch, woodlark, chough, raven, kingfisher, turtle dove, stock dove, sandpiper, terns (all species), black guillemot, swan.

4. This Order shall come into force on the 1st day of January, 1942.
