STATUTORY RULES AND ORDERS. 1941. No. 309.

GARDA SIOCHANA (RETIREMENT) REGULATIONS, 1941.

WHEREAS it is enacted by paragraph (b) of sub-section (1) of section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), as adapted in consequence of the enactment of the Constitution, that the Minister for Justice may from time to time, subject to the approval of the Government, make regulations in relation to the promotion, retirement, degradation, dismissal and punishment of members of the Gárda Síochána :

NOW, the Minister for Justice, in exercise of the powers conferred on him by paragraph (b) of sub-section (1) of section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), as adapted in consequence of the enactment of the Constitution, and of every and any other power him in this behalf enabling, hereby makes, with the approval of the Government, the following regulations :

1. (1) These Regulations may be cited as the Gárda Síochána (Retirement) Regulations, 1941.

(2) These Regulations and the Gárda Síochána (Retirement) Regulations, 1934 ( S. R. & O. No. 146 of 1934 ), may be cited together as the Gárda Síochána (Retirement) Regulations) 1934 and 1941.

2. These Regulations shall be construed as one with the Gárda Síochána (Retirement) Regulations, 1934, and, accordingly every expression which is given a particular meaning by the latter Regulations for the purposes thereof has in these Regulations the meaning so given to it.

3. (1) This regulation applies to every member of the Gárda Síochána (whether he became a member before or after the making of this Order) who is an officer.

(2) Whenever the Commissioner certifies in writing that, in his opinion, it is in the interests of the efficiency of the Gárda Síochána that any member of the Gárda Síochána to whom this regulation applies should retire, the Government may order the retirement of such member.

4. (1) This regulation applies to every member of the Gárda Síochána (whether he became a member before or after the making of this Order) who is not an officer and who has completed his period of probation.

(2) Whenever the Commissioner is of opinion that it is in the interests of the efficiency of the Gárda Síochána that any member of the Gárda Síochána to whom this regulation applies should retire, the Commissioner may order the retirement of such member.
