UNEMPLOYMENT ASSISTANCE (THIRD EMPLOYMENT PERIOD) ORDER, 1940.

UNEMPLOYMENT ASSISTANCE (THIRD EMPLOYMENT PERIOD) ORDER, 1940, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 24TH DAY OF MAY, 1940, PURSUANT TO SUBSECTION (3) OF SECTION 4 AND SUBSECTION (1) OF SECTION 7 of THE UNEMPLOYMENT ASSISTANCE ACT, 1933 (No. 46 OF 1933).

WHEREAS it is enacted by subsection (3) of section 4 of the Unemployment Assistance Act, 1933 (No. 46 of 1933), that the Minister for Industry and Commerce may by regulations made by him under that Act prescribe, either generally or in respect of any particular class or classes of persons or any particular district or districts, any period to be an employment period and accordingly no person of such class or resident in such district shall during such employment period be regarded as unemployed within the meaning of that Act :

AND WHEREAS it is enacted by subsection (1) of section 7 of the said Act that the Minister for Industry and Commerce may by order make regulations prescribing any matter or thing which is referred to in the said Act as prescribed or to be prescribed or any matter or thing which is expressly authorised by the said Act to be prescribed by regulations made by the said Minister under the said Act :

NOW, THEREFORE, the Minister for Industry and Commerce, in exercise of the powers conferred on him by subsection (3) of section 4 and subsection (1) of section 7 of the Unemployment Assistance Act, 1933 (No. 46 of 1933), and of every and any other power him in this behalf enabling, hereby orders as follows, that is to say :—

1. This Order may be cited as the Unemployment Assistance (Third Employment Period) Order, 1940.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order—

the expression "the No. 1 Order" means the Unemployment Assistance (Employment Periods) Order, 1940 (Statutory Rules and Orders No. 86 of 1940) ;

the expression "the No. 2 Order" means the Unemployment Assistance (Second Employment Period) Order, 1940 (Statutory Rules and Orders No. 87 of 1940).

4. The following regulations shall have effect for the purposes of subsection (3) of section 4 of the Unemployment Assistance Act, 1933 (No. 46 of 1933), that is to say :—

I. The period commencing on the 5th day of June, 1940, and ending on the 29th day of October, 1940, shall be an employment period in respect of the following class of persons, namely, every person whose place of residence is not situate within the boundary of any county or other borough or of any urban district or of any town.

II. Regulation I of these Regulations shall not apply to—

(a) any person who belongs to a class to which the No. 1 Order applies, or

(b) any person who belongs to a class to which the No. 2 Order applies, or

(c) any married man—

(i) who has a dependant, and

(ii) whose place of residence is situate within any district electoral division set out in the Schedule hereto, and

(iii) who is the occupier of land, entered as such in the valuation list within the meaning of the Valuation Acts, of which the annual rateable value or the aggregate annual rateable values under the Valuation Acts is less than four pounds.

III. For the purposes of these Regulations, any land let for depasturage for a period of less than one year shall be deemed to be occupied by the person who was the occupier thereof immediately before such letting.

IV. Nothing in these Regulations shall be construed as affecting the operation of the No. 1 Order or the No. 2 Order.
