CREAMERY BUTTER (LEVY) ORDER, 1939.

WHEREAS it is enacted by sub-section (1) of Section 18 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), that the Minister for Agriculture may from time to time by order make regulations prescribing the rates of levy under Part III of the said Act on creamery butter, and may at any time by order revoke any such Order :

AND WHEREAS it is enacted by sub-section (2) of the said section that the said Minister may by regulations made under the said section prescribe different rates of levy on different classes (defined in such manner as the said Minister shall think proper) of any particular substance, and may prescribe the date on which any particular rate of levy shall come into force :

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and of every and any other power me in this behalf enabling, do by this Order make the following regulations :—

1. This Order may be cited as the Creamery Butter (Levy) Order, 1939.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The Creamery Butter (Levy) (No. 3) Order, 1938 (Statutory Rules and Orders, No. 332 of 1938), is revoked as on and from the 1st day of April, 1939.

4. The rate of levy on creamery butter manufactured on or after the 1st day of April, 1939, shall be eleven shillings the hundredweight, and such rate shall come into force as on and from the 1st day of April, 1939.

5. The rate of levy on creamery butter which was put into cold store by registered proprietors of creamery premises on or before the 17th day of September, 1938, under and in accordance with an arrangement sanctioned by the Minister for Agriculture, shall be nine shillings the hundredweight, and such rate shall come into force as on and from the 1st day of April, 1939.

6. The rate of levy on creamery butter which was held by or on behalf of the registered proprietors of creamery premises on the 30th day of November, 1938, other than creamery butter of the class specified in the immediately preceding Article, shall be six shillings the hundredweight, and such rate shall come into force as on and from the 1st day of April, 1939.

7. No levy shall be payable on creamery butter manufactured between the 1st day of December, 1938, and the 31st day of March, 1939, both dates inclusive.
