STATUTORY RULES AND ORDERS. 1938. No. 220.

CONDITIONS OF EMPLOYMENT (DIVISION OF INDUSTRIAL UNDERTAKING) (CORK COUNTY COUNCIL) ORDER, 1938.

WHEREAS by sub-section (1) of Section 58 of the Conditions of Employment Act, 1936 (No. 2 of 1936), the Minister for Industry and Commerce may by order, if and whenever he so thinks fit, on the application of an employer within the meaning of that Act carrying on an industrial undertaking within the meaning of that Act, declare that any one or more of the departments, branches, or other parts of such undertaking shall, for all purposes or any specified purposes of that Act, be deemed to be separate industrial undertakings :

NOW, the Minister for Industry and Commerce, on the application of the Cork County Council and in exercise of the powers conferred on him by Section 58 of the Conditions of Employment Act, 1936 (No. 2 of 1936) and of every and any other power him in this behalf enabling, hereby orders as follows :

1. This Order may be cited as the Conditions of Employment (Division of Industrial Undertaking) (Cork County Council) Order, 1938.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. References in this Order to the exercise and performance by the Cork County Council of their statutory powers and duties shall be construed and have effect as references to such exercise and performance in so far only as such exercise and performance constitutes an industrial undertaking within the meaning of the Conditions of Employment Act, 1936 (No. 2 of 1936).

4. The exercise and performance by the Cork County Council of their statutory powers and duties shall, in so far as such exercise and performance relates to the functional area of the town commissioners of Bandon, be deemed for the purposes of Section 31 of the Conditions of Employment Act, 1936 (No. 2 of 1936), to be a separate industrial undertaking.

5. The exercise and performance by the Cork County Council of their statutory powers and duties shall, in so far as such exercise and performance relates to the functional area of the town commissioners of Bantry, be deemed for the purposes of Section 31 of the Conditions of Employment Act, 1936 (No. 2 of 1936), to be a separate industrial undertaking.
