STATUTORY RULES AND ORDERS. 1938. No. 67.

UNDERSIZED SEA-FISH ORDER, 1938.

WHEREAS it is enacted by sub-section (1) of section 2 of the Sea Fisheries (Protection of Immature Fish) Act, 1937 (No. 33 of 1937), that the Minister for Agriculture may, whenever and so often as he thinks fit, by order declare that any specified kind of sea-fish which, when measured in the manner directed by such order, is less in dimension than the specified measurements, shall be, for the purpose of the said Act, undersized, and it is enacted by sub-section (3) of the said section that an order under the said section may relate to different kinds of sea-fish and in that case may contain different provisions in relation to each kind of sea-fish to which the order relates :

NOW, THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by section 2 of the Sea Fisheries (Protection of Immature Fish) Act, 1937 (No. 33 of 1937), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say :—

1. (1) This Order may be cited as the Undersized Sea-fish Order, 1938.

(2) This Order shall come into operation on the 1st day of May, 1938.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. (1) Each kind of sea-fish mentioned in the second column of the Schedule hereto which, when measured in the manner directed by sub-article (2) of this Article, is less in length than that specified in the third column of the said Schedule opposite the mention, in the said second column, of such kind of sea-fish shall be, for the purpose of the Sea Fisheries (Protection of Immature Fish) Act, 1937 , undersized.

(2) The length of each kind of sea-fish shall, for the purposes of this Article, be measured between the tip of the snout and the extreme end of the tail fin, or, if any portion of the snout or of the tail fin has been removed, between the extreme ends of the remaining portion of the snout and of the remaining portion of the tail fin.
