THE LOCAL OFFICES AND EMPLOYMENTS (GAELTACHT) (AMENDMENT) ORDER, 1938.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

WHEREAS in pursuance of Section 15 of the Local Government (Temporary Provisions) Act, 1923 , the Minister for Local Government and Public Health did by the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1937, make and prescribe rules and regulations with respect to the continuance of persons in the offices or employments specified in the said Orders where the duties of such offices or employments are to be performed in or in relation to the Gaeltacht as defined in the said Order or any part thereof:

AND WHEREAS it is expedient to amend the said Orders in manner hereinafter appearing:

NOW THEREFORE, the Minister for Local Government and Public Health, in exercise of the powers vested in him by Section 15 of the Local Government (Temporary Provisions) Act, 1923 , does by this his Order, order and direct as follows, that is to say:—

1.—(1) This Order may be cited as the Local Offices and Employments (Gaeltacht) (Amendment) Order, 1938.

(2) This Order shall be read and construed as one with the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1937, and may be cited collectively with those Orders as the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1938.

(3) In this Order the expression "he Order of 1937" means the Local Offices and Employments (Gaeltacht) (Amendment) Order, 1937, and other expressions have the meanings respectively assigned to them by the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1937.

2. This Order shall apply to every person who, at the date of this Order, holds an office or employment under a local authority and who was required by Article 3 of the Principal Order as amended by Article 2 of the Order of 1931, and the Order of 1934, the Order of 1935, the Order of 1936, and the Order of 1937, to satisfy the Minister before the 31st day of July, 1936, the 28th day of February, 1937, the 31st day of July, 1937, or the 28th day of February, 1938, that he or she possessed the knowledge of the Irish language mentioned in Article 3 of the Principal Order.

3. Article 3 of the Principal Order as amended by Article 2 of the Order of 1931, and the Order of 1934, the Order of 1935, the Order of 1936, and the Order of 1937 shall, in its application to a person to whom this Order applies, be amended so as to provide that such person may continue in his or her office or employment until the 31st day of July, 1938, inclusive, but shall not continue in such office or employment after the said 31st day of July, 1938, inclusive, unless, before the said date, the Minister is satisfied in accordance with the Principal Order that such person possesses the knowledge of the Irish language mentioned in the said Article 3 of the Principal Order.
