HOUSING (FINANCIAL AND MISCELLANEOUS PROVISIONS) ACT 1932 .

THE HOUSING (NEW HOUSES) ORDER, 1938.

The Minister for Local Government and Public Health in exercise of the powers conferred on him by Section 14 of the Housing (Financial and Miscellaneous Provisions) Act, 1932 , and by sub-section (4) which was inserted in Section 8 of the said Act by Section 7 of the Housing and Labourers Act, 1937 , by this his Order hereby makes the following regulations, that is to say:—

1. (1) This Order may be cited as the Housing (New Houses) Order, 1938.

(2) This Order and the Housing (New Houses) Orders, 1932 and 1936, shall be read as one Order and may be cited collectively as the Housing (New Houses) Orders, 1932 to 1938.

2. In this Order the expression "the Act" means the Housing (Financial and Miscellaneous Provisions) Act, 1932 ; and the expression "the principal Order" means the Housing (New Houses) Order, 1932.

3. Where a grant is sought by a person or public utility society from the Minister in respect of the erection of a new house to which Section 8 of the Act applies, such person or public utility society shall before commencing such erection give to the Minister an undertaking in the form set forth in the Schedule to this Order.

4. The regulations made by this Order shall be part of the prescribed regulations mentioned in Section 5 of the Housing (Financial and Miscellaneous Provisions) Act, 1932 .

....................................and referred to in the application made by me (us) on the.........day of................, 193.., to the appointed officer for a certificate in respect of the said erection for the purpose of obtaining from the Minister for Local Government and Public Health a grant in respect of the said erection, and having read the notes set out at the foot of this undertaking, do hereby undertake that throughout the erection of /images/v13p0345c.gifrates of wages will be paid and conditions of labour observed at least as advantageous to the persons employed in the said erection as the appropriate rates of wages or conditions of labour generally recognised by trade unions at the date which within the meaning of Section 8 of the above-mentioned Act is the date of the commencement of the house.

NOTES.

1.

Section 8 of the Housing (Financial and Miscellaneous Provisions) Act, 1932 , applies to every house erected in an urban area by a public utility society or by a person who is by trade a builder under a contract or for the purpose of being let or sold.

2.

For the purposes of the above-mentioned Section 8, the date of the commencement of a house erected under a contract is the date of the contract, and the date of commencement of any other house is the date when its erection is begun.

3.

Failure to observe this undertaking will render the applicant liable to repay to the Minister the amount of any grant paid.
