STATUTORY RULES AND ORDERS. 1938. No. 11.

LOCAL REGISTRATION OF TITLE (COLLECTION OF FEES REGULATIONS, 1938.

WHEREAS it is enacted by section 3 of the Public Offices Fees Act, 1879, as adapted by or under the Adaptation of Enactments Act, 1922 , (No. 2 of 1922), and the Constitution (Consequential Provisions) Act, 1937 , (No. 40 of 1937), that the Minister for Finance may from time to time make and when made revoke, alter or add to regulations for certain purposes respecting fees in any public office, and amongst. others for the purpose of determining the use of impressed or adhesive stamps, and the mode of cancellation of adhesive stamps, and that any such regulations so far as they relate to the office of any court of law, shall be made with the consent of the Chief Justice:

AND WHEREAS the Land Registry is a public office and an office of a Court of Law within the meaning of the said Act:

AND WHEREAS by virtue of the Local Registration of Title (Collection of Fees) Order, 1938 (Statutory Rules and Orders No. 10 of 1938), each of the several fees payable in the Land Registry under the provisions of the Local Registration of Title (Ireland) Act, 1891, is to be collected by means of stamps:

NOW, the Minister for Finance, with the consent of the Chief Justice testified by his signature to these regulations, in exercise of the powers conferred on him by section 3 of the Public Offices Fees Act, 1879, as adapted by or under the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and the Constitution (Consequential Provisions) Act, 1937 (No. 40 of 1937), and of every and any other power him in this behalf enabling, hereby makes the following regulations, that is to say:—

1. These Regulations may be cited as the Local Registration of Title (Collection of Fees) Regulations, 1938.

2. In these Regulations, the expression "the Land Registry" means the central office and every local office established and maintained in pursuance of section 4 of the Local Registration of Title (Ireland) Act, 1891.

3. The stamps to be used in the Land Registry for the collection of the several fees payable therein under the provisions of the Local Registration of Title (Ireland) Act, 1891, shall ho adhesive stamps which shall be cancelled by perforation.

4. All regulations in force immediately prior to the making of these Regulations which are made under the Public Offices Fees Act, 1879, in relation to the collection of fees in the Land Registry, are hereby revoked.
