BY-LAW No. 430No. 14 OR LETTERKENNY DISTRICT.

MAGHERY BAY

I, FRANK AIKEN, Acting Minister for Agriculture, by virtue and in exercise of the powers vested in me by Section 28 of the Fisheries Act, 1925 , the Fisheries (Re-distribution of Public Services) Order, 1934, and of every other power enabling me in this behalf, DO MAKE AND ORDAIN THE FOLLOWING BY-LAW:—

(1) Notwithstanding anything contained in the By-Law dated the 4th May, 1906, by which it is prohibited to use for the capture of sea fish any net with a mesh of less dimensions than one inch from knot to knot, or four inches in the round, (measured when the net is wet), in the sea off that part of the coast of the County of Donegal extending from Bloody Foreland to Rossan Point, it is permitted to use nets with meshes of less than one inch square in Maghery Bay, between Rinavar Point or Crohy Head, in the townland of Crohy, and the south-westernmost point of the townland of Termon, both in the County of Donegal.

(2) Such nets may be used in the said Maghery Bay only during the period from the 15th August to the 30th November following in each year, both said days inclusive.

(3) Nothing in this By-Law shall be construed so as to authorise the capture of any fish save in accordance with the law and By-Laws existing from time to time, other than the aforesaid By-Law dated the 4th May, 1906.

(4) The Interpretation Act, 1923 , (No. 46 of 1923) applies to the interpretation of this By-Law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(5) This By-Law may be cited for all purposes as the Maghery Bay By-Law, No. 430, 1937.
