SAORSTÁT ÉIREANN. 16/07/1937: COUNTY HEALTH DISTRICTS (PUBLIC SANITARY CONVENIENCES) ORDER, 1937

To the Council of every Administrative County not being a County Borough ; to the Board of Health for every County Health District ; and to all others whom it may concern :

WHEREAS by sub-section (2) of section 33 of the Local Government (Ireland) Act, 1898, as adapted by subsequent enactments and as applied to boards of health by Article 3 of the Local Government (Application and Adaptation of Enactments) Order, 1925, an Order made by the Minister for Local Government and Public Health (hereinafter referred to as " the Minister) pursuant to section 86 (1) of the Local Government Act, 1925 , it is provided in effect that boards of health established under the said last-mentioned Act shall have such powers and duties of urban sanitary authorities under the Public Health (Ireland) Acts, 1878 to 1896, or any other Act and such provisions of those Acts relating to urban districts shall apply to county health districts as the Minister by General Order direct ; and that every such Order shall be forthwith laid before the Oireachtais :

AND WHEREAS it appears to the Minister expedient to direct that boards of health shall with respect to public sanitary conveniences have the powers and duties of urban sanitary authorities under the provisions of the Public Health (Ireland) Acts, 1878 to 1896, hereinafter referred to and that such provisions should apply to county health districts :

NOW, THEREFORE, the Minister, in exercise of the powers vested in him as aforesaid, does by this his General Order, direct as follows, that is to say :—

1. This Order may be cited as the County Health Districts (Public Sanitary Conveniences) Order, 1937.

2. Every board of health shall for the purposes of the provision, maintenance and regulation of public sanitary conveniences within their county health district have the powers and duties of an urban sanitary authority under section 49 of the Public Health (Ireland) Act, 1878, and section 20 of the Public Health Acts Amendment Act, 1890, and the provisions of the said sections of the said Acts relating to urban districts shall apply accordingly to every county health district.

3. Any expenses to be incurred by a board of health in the exercise and performance of the powers and duties conferred on them by this Order are hereby declared to be special expenses, as defined in the Public Health (Ireland) Act, 1878.
