GREAT SOUTHERN RAILWAYS COMPANY ORDER MODIFYING THE ORDER SETTLING AND THE ORDER MODIFYING THE STANDARD CHARGES OF THE GREAT SOUTHERN RAILWAYS COMPANY.

SCHEDULE OF STANDARD CHARGES.

ORDER OF THE RAILWAY TRIBUNAL, DATED THE 3RD DECEMBER, 1937, MODIFYING THE ORDER SETTLING AND THE ORDER MODIFYING THE STANDARD CHARGES.

WHEREAS it is enacted by Section 54 of the Railways Act, 1924 ,* that the Railway Tribunal shall at the end of each year, unless directions are given by the Minister for Industry and Commerce to the contrary, review the Standard Charges and Exceptional Charges of the Great Southern Railways Company (hereinafter called " the Company ").

AND WHEREAS no such direction has been given by the Minister for Industry and Commerce.

AND WHEREAS we caused public notice to be given that we should sit at 11 a.m., on the 16th day of November, 1937, at the Four Courts, Dublin, for the purpose of holding the said Review.

AND WHEREAS on the 16th, 17th and 18th days of November, 1937, we have reviewed the said Standard Charges and Exceptional Charges on the experience of the operation of those Charges during the years 1934, 1935 and 1936 and have taken into consideration all submissions relative thereto and have in open Court heard the Company and all persons and bodies interested who desired to be heard.

AND WHEREAS we find that the Average Annual Net Revenue obtained by the Company during the period on the experience of which the Review is based is less than the Standard Revenue of the Company together with the allowance necessary to remunerate adequately the additional capital which has been raised or provided in respect of expenditure on capital account incurred since the date upon which the Standard Charges were fixed in the first instance, and that the deficiency is not due to lack of efficiency or economy in the management, and that the deficiency is likely to continue.

AND WHEREAS we have had regard to all the considerations directed by the said Section.

NOW WE, THE RAILWAY TRIBUNAL, in pursuance of the powers vested in US under the said Section DO HEREBY ORDER that the Schedule of Standard Charges of the Company as settled by Statutory Rule and Order, 1930, No. 5, and modified by Statutory Rule and Order, 1930, No. 56, be modified in accordance with the Schedule hereto.

AND WE FIX the 1st day of January, 1938, as the day from which the said modifications shall take effect.

Engines and Tenders, Railway Motor Carriages, Railway Trucks running on their own wheels.

Charges to be increased by five per cent.

In determining the amount to be added to the standard charge in operation prior to the date upon which this Order shall take effect fractions of one penny if less than one half shall be dropped and if one half or more shall be charged as one penny.

Charges included for services performed by the Company at the beginning and end of transit.

Charges to be increased by five per cent.

Private Owners' Wagons sent to Wagon Works for repairs, loaded on other trucks :—

(a) The service of loading.

Charges to be increased by five per cent.

(b) The provision of trucks when the Company's trucks are used.

The words " Fractions of one halfpenny to be charged as one halfpenny " to be deleted and the following substituted therefor :—

" Fractions of one penny to be dealt with as follows :—

" If under one quarter to be dropped, one quarter and less than three quarters to be charged as one halfpenny, three quarters and over to be charged as one penny."

Wild Animals (Conveyed only at Owner's Risk).

Charges to be increased by five per cent.

GROUP 6.

Bicycles, Invalid Chairs, and Other Articles when not conveyed in Trucks specially provided.

Charges to be increased by five per cent.

CHARGES IN RESPECT OF ENTRIES IN THE CLASSIFICATION OF GOODS BY MERCHANDISE TRAIN.

Charge for the supply of a sheet or sheets or a covered van in lieu thereof.

Charge to be increased by five per cent.

In determining the amount to be added to the standard charge in operation prior to the date upon which this Order shall take effect fractions of one penny if less than one half shall be dropped and if one half or more shall be charged as one penny.

Regulation 13.

Charges for the conveyance of Wild Animals by Merchandise Train.

Charges to be increased by five per cent.

Fractions of less than one halfpenny in the total charges to be dropped and fractions of one halfpenny or over to be charged as one penny.

MINIMUM CHARGE FOR THE CONVEYANCE OF HORSES, DEAD (KNACKERS).

Charges to be increased by five per cent.

SECTION I (D).—Dangerous Goods.

Items carrying a Minimum Money Charge.

Charges to be increased by five per cent.

In determining the amount to be added to the standard charge in opera ion prior to the date upon which this Order shall take effect, fractions of one penny if less than one half shall be, dropped and if one half or more shall be charged as one penny.

SECTION II.—Live Stock.

Regulation 7.

Charge for the cleansing of Trucks.

Charge to be increased by five per cent.

In determining the amount to be added to the standard charge in operation prior to the date upon which this Order shall take effect fractions of one penny if less than one half shall be dropped and of one half or more shall be charged as one penny.

PART (2).

Statutory Rule and Order, 1930, No. 56, to be modified as follows :—

SCALE OF CHARGES FOR THE CONVEYANCE OF PASSENGERS.

Charges to be increased by five per cent.

In determining the amount to be added to the standard fares under one shilling in operation prior to the date upon which this Order shall take effect the amount shall be determined and charged as one halfpenny.

SCALE OF CHARGES FOR ORDINARY SEASON TICKETS.

Charges to be increased by five per cent.
