CONTROL OF IMPORTS (QUOTA No. 14) (AMENDMENT) ORDER, 1937.

WHEREAS it is enacted by Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), that the Executive Council may at any time by order amend or revoke any quota order or other order previously made under the said Act, including an order made under the said Section 11 amending a previous order :

AND WHEREAS it is enacted by sub-section (1) of Section 3 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), that the Executive Council may amend, under Section 11 of the Control of Imports Act, 1934 , any quota order made before the passing of the Control of Imports (Amendment) Act, 1937 , by inserting in such quota order any provision which could lawfully have been inserted therein if that Act had been in force when such quota order was made :

AND WHEREAS by Section 2 of the Control of Imports (Amendment) Act, 1937 , it is enacted that the Executive Council may, in and by a quota order, do all or any of certain specified things :

AND WHEREAS on the 22nd day of March, 1935, the Executive Council, in exercise of the powers conferred on them by Section 3 of the Control of Imports Act, 1934 , made the Control of Imports (Quota No. 14) Order, 1935 (Statutory Rules and Orders, No. 64 of 1935) :

NOW, the Executive Council, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, and of every and any other power them in this behalf enabling do hereby order as follows :—

1. This Order may be cited as the Control of Imports (Quota No. 14) (Amendment) Order, 1937.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The Control of Imports (Quota No. 14) Order, 1935 (Statutory Rules and Orders, No. 64 of 1935), is hereby amended in the following respects and shall be construed and have effect accordingly, that is to say :—

(i) by the deletion in paragraph 4 of the words " of any of the descriptions specified in the Schedule hereto " and the substitution therefor of the words " which, in the opinion of the Revenue Commissioners, are designed, constructed, and intended for use on mechanically propelled vehicles (other than bicycles and tricycles) ", and

(ii) by the deletion of the Schedule to the said Order, and

(iii) by the deletion in paragraph 5 of sub-paragraphs (c) and (d) and the substitution therefor of the following sub-paragraphs, that is to say :—

" (c) is shown to the satisfaction of the Revenue Commissioners to be imported solely for use as a sample, or

(d) is imported under and in accordance with a licence in that behalf issued under the Control of Imports Acts, 1934 and 1937, or

(e) is an article to which this Order is precluded, by Section 4 of the Control of Imports (Amendment) Act, 1937 , from applying. "

4. This Order shall come into operation on the 1st day of October, 1937.
