STATUTORY RULES AND ORDERS. 1937. No. 101.

CORK DISTRICT MILK BOARD (MINIMUM PRICES FOR MILK) ORDER, 1937.

WHEREAS it is enacted by sub-section (1) of Section 43 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), that where the determination of a board for a joint district under Section 42 of the said Act has been communicated to the Minister for Agriculture, the said Minister shall consider such determination and thereupon the following provisions shall have effect, that is to say—

(a) in case such determination is the first determination of such board, the said Minister shall make an order fixing—

(i) the minimum prices to be paid to registered producers in respect of such district for milk sold by them to registered retailers in respect of such district, and

(ii) the minimum prices to be paid to such registered producers for milk sold by them to registered wholesalers in respect of such district ;

(b) in any other case, the said Minister may, if he thinks proper, do any of the following things—

(i) revoke any order previously made by him under the said Section 43 and then in force, and, if he thinks proper, make a new order fixing the said prices ;

(ii) amend any order previously made by him under the said Section 43 and then in force :

AND WHEREAS it is enacted by sub-section (2) of the said Section 43 that in making an order under the said section the said Minister may fix different prices in respect of milk sold under different sets of conditions (defined in such manner and by reference to such things as the said Minister thinks proper):

AND WHEREAS a determination of the Cork District Milk Board (being a board for a joint district) under the said Section 42, was communicated to the said Minister and such determination was the first determination of the said Board :

AND WHEREAS the said Minister has considered the said determination:

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in pursuance of sub-section (1) of Section 43 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and in exercise of the powers conferred on me by the said sub-section and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Cork District Milk Board (Minimum Prices for Milk) Order, 1937.

2. In this Order—

the expression "registered producers" means persons registered in the register of producers kept by the Cork District Milk Board ;

the expression "registered retailers" means persons registered in the register of retailers kept by the Cork District Milk Board ;

the expression "registered wholesalers" means persons registered in the register of wholesalers kept by the Cork District Milk Board.

3. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

4. The minimum prices to be paid to registered producers for milk sold by them to registered retailers shall be at the following rates:—$110:

(a) where the milk is delivered at the premises of the registered producer, eight pence halfpenny per gallon ;

(b) where the milk is delivered at a place other than the premises of the registered producer, nine pence halfpenny per gallon.

5. The minimum prices to be paid to registered producers for milk sold by them to registered wholesalers shall be at the following rates—

(a) where the milk is delivered at the premises of the registered producer, eight pence halfpenny per gallon ;

(b) where the milk is delivered at any place other than the premises of the registered producer, eight pence halfpenny per gallon.
