STATUTORY RULES AND ORDERS. 1936. No. 241.

HOME-GROWN MILLABLE WHEAT (MINIMUM PRICES FOR SALE (WHEAT) YEAR, 1938-39) ORDER, 1936.

WHEREAS it is enacted by sub-section (2) of Section 12 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935), that the Executive Council shall from time to time by order do, in respect of each sale (wheat) year (other than the sale (wheat) year 1935-36, and the sale (wheat) year 1936-37) commencing after the 29th day of July, 1935, the following things:—

(a) divide by reference to bushel weights, home-grown millable wheat, the bushel weight of which is not less than the bushel weight declared by such order to be the minimum bushel weight for the purposes of classification, into such and so many classes as they think fit;

(b) fix in respect of wheat of each such class and in respect of each month in such sale (wheat) year, the price, in terms of a rate per barrel, of wheat of that class for that month:

AND WHEREAS it is enacted by sub-section (3) of the said Section 12 that every order made under sub-section (2) of the said Section 12 shall be made not later than two years before the commencement of the sale (wheat) year to which it relates:

NOW, THEREFORE, the Executive Council, in pursuance of sub-sections (2) and (3) of Section 12 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935), and in exercise of the powers conferred on them by the said sub-section (2) and of every and any other power them in this behalf enabling, hereby order as follows:—

1. This Order may be cited as the Home-grown Millable Wheat (Minimum Prices for Sale (Wheat) Year, 1938-39) Order, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The following provisions shall have effect in relation to the sale (wheat) year commencing on the 1st day of September, 1938, that is to say:—

(a) a bushel weight of fifty-six pounds is hereby declared to be the minimum bushel weight for the purposes of classification, and the expression " home-grown millable wheat to which this Order applies " means in this Order home-grown millable wheat the bushel weight of which is not less than fifty-six pounds;

(b) for the purposes of this Order, home-grown millable wheat to which this Order applies is hereby divided into the nine classes specified in the second column of the Schedule hereto;

(c) the minimum price per barrel for home-grown millable wheat to which this Order applies of each class specified in the second column of the Schedule hereto for each month in such sale (wheat) year shall be the price set out opposite the mention of wheat of that class in the sub-column relative to such month of the third column of the said Schedule.
