NON-CREAMERY BUTTER (LEVY) (No. 2) ORDER, 1936.

WHEREAS it is enacted by Section 18 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), that the Minister for Agriculture may from time to time by Order make regulations prescribing the rates of levy under Part III of the said Act on non-creamery butter, and may at any time by order revoke or amend any such order, and may by any such order prescribe different rates of levy on different substances and on different classes (defined in such manner as the said Minister shall think proper) of any particular substance and the date on which any particular rate of levy shall come into force:

AND WHEREAS it is enacted by Section 19 of the said Act that the Minister for Agriculture may at any time by order declare that there shall be no levy under Part III of the said Act in respect of any month beginning after the end of a specified levy month (ending after the date of such order) on any specified substance or substances or any specified class (defined in such manner as the said Minister shall think proper) of any particular substance, and may at any time revoke any such order either wholly or in respect of one or more substances or classes of substance:

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and of every and any other power me in this behalf enabling, do by this Order make the following regulations:—

1. This Order may be cited as the Non-Creamery Butter (Levy) (No. 2) Order, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The Non-Creamery Butter (Levy) Order, 1936 (Statutory Rules and Orders, No. 108 of 1936), is revoked as on and from the 1st day of May, 1936.

4.—(1) Save as hereinafter provided, the rate of levy on non-creamery butter shall be whichever of the following rates is applicable to any particular class of non-creamery butter, that is to say:—

(a) On non-creamery butter which was put into cold store on or before the 2nd day of November, 1935, under and in accordance with an arrangement sanctioned by the Minister for Agriculture, the rate of twenty-two shillings the hundredweight.

(b) On non-creamery butter to which the foregoing sub-paragraph (a) of this paragraph does not apply which was manufactured on or before the 30th day of November, 1935, the rate of twenty-eight shillings the hundredweight.

(c) On non-creamery butter manufactured during the month of December, 1935, the rate of eighteen shillings and eight pence the hundredweight.

(d) On non-creamery butter manufactured on or after the 1st day of April, 1936, the rate of twenty-eight shillings the hundredweight.

(2) The rates of levy mentioned in and prescribed by this paragraph shall come into force as on and from the 1st day of May, 1936.

(3) This paragraph shall not apply to non-creamery butter manufactured from cream on which a levy at the appropriate rate has been paid.

(4) No levy shall be payable on non-creamery butter manufactured during the period from the 1st day of January, 1936, to the 31st day of March, 1936.
