CONDENSED MILK (LEVY) ORDER, 1936.

WHEREAS it is enacted by Section 18 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), that the Minister for Agriculture may from time to time by order make regulations prescribing the rates of levy under Part III of the said Act on milk products and may by any such order prescribe different rates of levy on different substances and on different classes (defined in such manner as the Minister shall think proper) of any particular substance and may prescribe different methods of calculating the levy in respect of different substances and the date on which any particular rate of levy shall come into force :

AND WHEREAS by virtue of Section 3 of the said Act, condensed milk is a milk product for the purposes of the said Act :

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and of every and any other power me in this behalf enabling, do by this Order make the following regulations :—

1. This Order may be cited as the Condensed Milk (Levy) Order, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. (1) The levy on any particular quantity of condensed milk shall be calculated and paid at the rate of three halfpence per gallon of whole milk used in the manufacture of the said quantity of condensed milk and such levy shall come into force as on and from the 1st day of May, 1936.

(2) This Order shall not apply to condensed milk which is packed in hermetically sealed tins which contain not more than 16 ounces of condensed milk.
