LONDONDERRY AND LOUGH SWILLY (CARNDONAGH EXTENSION) LIGHT RAILWAY ORDER, 1898, AMENDMENT ORDER, 1935.

THE LONDONDERRY AND LOUGH SWILLY (CARNDONAGH EXTENSION) LIGHT RAILWAY ORDER, 1898, AMENDMENT ORDER, 1935, MADE ON THE 31st DAY OF DECEMBER, 1935, BY THE MINISTER FOR INDUSTRY AND COMMERCE UNDER SECTION 2 OF THE RAILWAYS (IRELAND) ACT, 1896.

WHEREAS it is enacted by section 2 of the Railways (Ireland) Act. 1896, that where such agreement as is authorised by sub-section (1) of section 4 of the Light Railways (Ireland) Act, 1889, has been made by the Treasury with a railway company, section 5 of the Light Railways (Ireland) Act, 1889, relating to the Order in Council to confirm the agreement, shall apply with certain modifications thereof including the following modification, that is to say :—

(d) The Order may upon the application of the Treasury be altered or added to by an amending Order made in like manner and subject to the like provisions as the original Order :

AND WHEREAS the Londonderry and Lough Swilly (Carndonagh Extension) Light Railway Order, 1898 (hereinafter in this Order called the original Order) made pursuant to the Tramways (Ireland) Acts, 1860 to 1896, has confirmed the agreement set out in the Third Schedule thereto, being an agreement made on the 11th day of March, 1897, between the Treasury of the first part, the Commissioners of Public Works of the second part, and the Londonderry and Lough Swilly Railway Company (hereinafter in this Order called the Company) of the third part :

AND WHEREAS the Minister for Finance has agreed with the Company that the agreement confirmed as aforesaid by the original Order shall be modified as follows, that is to say, by the deletion as on and from the 1st January, 1935, of Clause 17 now contained in the said agreement, to the intent that the Minister for Finance shall not after such date be entitled to receive any moneys from the Company under the said Clause, and has made application to the Minister for Industry and Commerce that the original Order be altered or amended by an amending Order for the purpose of giving effect to the said modification of the agreement :

NOW THEREFORE, the Minister for Industry and Commerce in exercise of the powers conferred on him by paragraph (d) of section 2 of the Railways (Ireland) Act, 1896, and of every other power him in this behalf enabling, does hereby order as follows:—

1. The modification agreed upon between the Minister for Finance and the Company of the agreement made on the 11th day of March, 1897, and set out in the Third Schedule to the original Order, that is to say, the deletion of Clause 17 of the said agreement, as on and from 1st January, 1935, is hereby confirmed and the original Order shall be construed and have effect accordingly.

2. This Order may be cited for all purposes as the Londonderry and Lough Swilly (Carndonagh Extension) Light Railway Order, 1898, Amendment Order, 1935.
