SAORSTÁT ÉIREANN. 11/05/1935: LOCAL GOVERNMENT (IRELAND) ACT, 1902 (ADAPTATION) ORDER, 1935

WHEREAS by sub-section (1) (b) of section 86 of the Local Government Act, 1925 (hereinafter referred to as " the Act "), it is provided that the Minister for Local Government and Public Health (hereinafter referred to as " the Minister ") may by order make such adaptations of any existing enactment (including any Local Act) relating to any matter dealt with or affected by the Act as appear to him necessary or expedient for carrying the Act into effect :

AND WHEREAS section 10 of the Local Government (Ireland) Act, 1902, is an existing enactment within the meaning of section 86 of the Act, relating to a matter affected by the Act :

AND WHEREAS it appears to the Minister necessary and expedient for carrying the Act into effect to make the adaptations hereinafter appearing of the said section 10 of the Local Government (Ireland) Act, 1902 :

NOW, THEREFORE, the Minister in exercise of the powers vested in him by sub-section (1) (b) of section 86 of the Act, does hereby order as follows, that is to say :—

1. This Order may be cited as the Local Government (Ireland) Act, 1902 (Adaptation) Order, 1935.

2. The Interpretation Act, 1923 , shall apply to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. Section 10 of the Local Government (Ireland) Act, 1902, shall be adapted in the manner and to the extent necessary to enable the same to be read as follows :—

10. The provisions of section one of the Local Officers Superannuation Act (Ireland), 1869, and of Part IV of the Local Government Act, 1925 , as amended by any subsequent enactment, which prohibit a public body named in the Schedule to the said first-mentioned Act from granting a superannuation allowance to an officer unless his whole time has been devoted to the service of that body, shall not have effect in the case of a medical officer of health of an urban district or any existing officer within the meaning of the Principal Act.
